Timeline

My mum got a vistor vias valid for 5 yers and it's multipe entery ..I have just booked her ticket for 3 month to stay with me..what i sthe maximum time my mum is allowed to stay in USA in each time she visits me ???

AOS JOURNEY:

2007- April -25: AOS SENT AND FILED

2007- April -27:AOS package delivered

2007- May -05: NOA1 recieved in Mail

2007- May -23: Biometrics Appointment @ 9 Am

2007- May -15: RFE recieved

2007- June-05:RFE paper sent

2007- June-08: RFE recieved

2007- August- 08 : Interview at 10 A.M

2007- october- 04 :Card production ordered

2007-october- 05: Welcome letter recieved in mail

2007-october-11 : Approval notice sent

If found admissible, a B-2 shall be admitted for 6 months. The district director may delegate individual review of the minimum admission period no lower than a supervisory inspector. Referral of individual cases to the supervisor may occur when it is evident that the alien is admissible, but does not have sufficient resources available to maintain a 6 months visit. The Service does not require that an applicant for admission have with him or her funds to maintain a 6-month stay, but the applicant mus t demonstrate that he/she has access to sufficient resources. A B-1 shall be admitted for a period of time which is fair and reasonable for completion of the purpose of the trip. Any decision to reduce a B-1's admission from the time requested shall be authorized by a supervisor. (TM 185)

Hmmm...Weird. I would think that the 5 year visa will let her stay in the US for that 5 years without having to stay for just 90 days. The multiple entry means that if she leave the US, and re-enter she would have the privilege to do so if she wanted.

I have a multiple entry visa too from another country. It doesn't specify an expiration date, and it mentioned permanent stay on it. It means that I can live in that country if I wanted without even coming back to the US.

I would ask NVC or someone who experienced that same situation for the solution.

just because you have a visa that is valid for 5 years does not mean you are allowed to stay for 5 years. That's like saying a Canadian can come here indefinately even if its "only a 2 year visit". that is not how it works, and we are not talking about a "permanent stay" visa - this is most likely a B2 we are talking about.

I am also disputing the 90 days. I believe that is just a thought carried over from the VWP program.

You are probably right about this and why I was under the impression it was 90 days.
