Oh no, we're filing a month late! We thought the green card didn't expire until June, but it expires in May. Do you guys think that we are really screwed in it now? I'm hoping not, but does anybody know what we should expect? Thanks

Mar 13 2007 - I-751 Check for I-751 + Biometrics Cashed (wow same day it arrived!)

Mar 14 2007 - NOA sent from USCIS

Mar 29 2007 - NOA & Biometrics Appt Received

Apr 06 2007 - Biometrics Appt

Jan 31 2008 - Case transferred from TSC to VSC

Apr 16 2008 - Case Approved New Green Card Ordered

2/1/05 - received interview letter for May 16, 2005

5/16/05 - Successful (and fast) AOS interview in Cherry Hill!!!

3/9/07 - cashed 70.00 biometrics check

3/16/07 - received blue receipt notice for biometrics fee

3/24/07 - received NOA extending GC for another year

my wifes card expires TODAY. we got our papers in yesterday.

The thing you have to remember is that once your GC expires, you cannot leave the US and re-enter, unless you have the NOA from the I-751 application, which extends your GC for one year, and includes employment and travel authorization.

So, you don't need to apply exactly 90 days before your GC expires, but if you plan to leave the US, keep in mind that the NOA can take up to a month to be received.

I hope this is true - we're going to be a full 6 months behind filing, and although my wife does not need to travel, we know that the status is automatically terminated as we didn't file I-751 on time.

The above *is* true, but does not apply to you. The situation being discussed is that of someone who has filed on time but has not received their extension letter before their conditional GC expired. Your situation is that you have not filed on time -- very different circumstance.
