:wacko: hello everyone..!!!

this question just came across my mind today. I got married in India. Now, how do I establish my marriage in US? I m going to file W7 and file 2006 return as joint w/ my wife. that does it..?? I guess , what I am asking is, do you have to tell someone( county / state offices ) that I got married outside US and want to registger our marriage here in US as well..?? just a random thougt...ne comments will be appreciated..thanks..gluck to everyone...

12/12/2011 -- Got NOA1 ONLY for mom's file

4/25/2007 -- notice received in mail

5/10/2007 -- NVC recieved case (finally, after 3 weeks)

5/14/2007 -- NVC sent case to Mumbai embassy

5/31/2007 -- wife sent in packet 3

6/15/2007 -- wife received packet 4

8/23/2007 -- INTERVIEW DATE wohooooo + got K3 visa on 23rd :)

9/03/2007 -- sweetheart is here in US

AOS - EAD

9/17/2007 -- AOS/EAD package sent to chicago lock box

9/26/2007 -- NOA 1s for 485 & EAD

10/1/2007 -- biometrics appt letter received

10/13/2007 -- fingerprinting....speed it up guys..

11/28/2007 -- card production ordered - EAD

03/04/2008 -- final interview for greeen card :)

I married my wife in the US and didn't send them a copy of the marriage certificate. I don't know if you need to establish anything stateside. As long as your India marriage certificate is recognized by the US as a legal marriage I think you are ok. I'd call the IRS just to be sure though. I had filed for the W-7 for my wife and included the necessary document (Notarized copy of Passport). They never asked for anything like a marriage certificate though.

02/17/2007 - I-130 Express Mailed to VSC via USPS. (ETA 2/19/2007)

02/22/2007 - I-130 received by VSC.

06/12/2007 - NOA2 approval email received!!!

06/15/2007 - NOA2 letter received in the mail.

NVC

06/19/2007 - NVC receives case and assigns a case number!

08/27/2007 - CASE COMPLETE!!!!

09/06/2007 - Case forwarded to Sydney

09/14/2007 - Wife receives Packet 3. Received NVC letter confirming case forward to Sydney.

10/26/2007 - Interview - VISA GRANTED!!!!! WOOO WOOO!!!!!!

11/18/2007 - Enter the US via LAX (POE). No issues thankfully. 20 minutes of processing.

11/30/2007 - Welcome letter (two of them) received.

12/19/2007 - CR-1 Green Card received.

USCIS - I-751

09/23/2009 - Express Mailed Removal of Conditions application

09/24/2009 - USPS confirmed delivery to VSC

09/29/2009 - Check cashed by USCIS

10/01/2009 - Received NOA I-797C dated 09/25/2009

10/10/2009 - Received Biometric appt letter for 10/29/2009

10/29/2009 - Biometrics taken. Whole process took about 40 min including the wait

12/22/2009 - Approved for ROC!

01/08/2010 - Received text and email: Card production ordered

01/15/2010 - Received Green Card in the mail!

USCIS - N-400

04/22/2011 - Express Mailed Application for Naturalization

04/27/2011 - Check cashed by USCIS

04/28/2011 - Received NOA I-797C dated 04/26/2011

05/27/2011 - Biometrics taken. Process took approx 35 min with wait

07/29/2011 - Received Interview Appt letter scheduled for 09/01/2011 dated 07/26/2011

09/01/2011 - Interview and Oath. Now a USC! The VJ is over!

I live in Massachusetts and I contacted the Dept. of Vital Records to find out if I had to file my marriage certificate with them. They said I don't need to if it's registered in another country. Might be different from state to state.

You do not need to register your marriage in the US to file for the W-7 ITIN along with the current year tax return. I filed my husband's ITIN along with our joint 2006 taxes. One thing I did since I have taken his name is that I took care of that immediately with the Social Security Administration, my name needed to be a correct match between the 2006 tax filing and the SSA. Then I followed through with drviers license, bank account, etc...these were not required to file the ITIN and tax return though.

I have learned first hand that the IRS is way different from immigration, it has been the easiest and most helpful government office to work with. They answered all my questions and helped to make sure I was providing all documents they need for his ITIN. They even said I could make an appointment to come in and file everything in person.

You could give them a call if you want to ease your mind about the requirements but as long as you are providing the completed W7 form signed by your wife, all supporting certified docs with your 2006 tax filing then you are fine. :thumbs:
