Hello

Me again...another question. Tried to google this one too, but found nothing.

If I am going to file with a co-sponsor and my co-sponsor has in the past (5 yrs ago) filed themselves a petition with INS.... can they still co-sponsor me?

My co-sponsor 5yrs sponsored her brother to come to the US... and since then the brother has LPR status. So can this person now be my co-sponsor or is there some limit ?

Yes, they can be a co-sponser. However, when they fill out the form they must include themselve as member of the household including the brother, unless the brother has meet the requirements of 40-work credits or can place into an income category that is sufficient for self-independent. In other words, the brother will be counted into the household member list when filing if he is not self-independent. If the brother is listed, then the income requirements will need to be adjusted to meet the 125% Federal Poverty Guidelines in order to qualify as co-sponser.

The 'or' phrase in your statement is not correct. There are 5 ways for the proposed joint sponsor's obligation for the brother to end, and "can place into an income category that is sufficient for self-independent" is not one of them.
