Last Year I didn't work much-Not qualified to sponsor her

Due to 4 trips to Vietnam last year to see my fiancee, now I just recieve my W-2 form and I made only 5500 USD in 2006 only. but I have a letter from my employer stating that I have been employed by the company for 3 year and my salary is 18/hour . so what can I do now ? should I go find a co-sponsor ? or bank statment and letter from employer are good enough ?

I-129F sent and recieved by USCIS on Feb 16th, 2007-Also I fly to Vietnam to see my fiancee on today. This is the 4th times I have flied to vietnam within a year time frame. I miss her.

I think every consulate is different but because I didn't start working until March and took a total of 30days off to visit Veronica... I made only $12,995 on my 1040 But with my wage stubs and employment letter I actual make over $30,000 oh and I changed to the better paying job Sept 5th.. and we were approved with no problem... I did include a Explanation Letter..On why I didn't have the $13200 for 2006 that is required..

I'm pretty sure they look at the future income more.... And with a good employment letter ..I don't think you'll have a problem.. But then I was pretty close in the first place with only really working 8.5 months..

Is a sponser a problem ???

9/19 NOA1 CSC Recieved

9/25 Notice date Check cashed 9/25

9/28 I Recieved NOA1(I-797C) in the mail

12/5 NOA2 12/6 but Approved on 12/5 touch

12/9 Received NOA2(I-797) by snail mail

12/15 NVC has received it..Case # issued...

12/19 NVC shipped to Romania

12/22 Romanian Embassy has received an email from NVC that my Petition is on it's way...

12/29 Packet 3 sent to Veronica

1/12 2007 Packet 3 received Dang Holidays..

1/22 Sending all paperwork(I-134,Bank/Employer letters etc..,)..to Veronica per DHL, 3.5lbs...$144 WOW!

1/25 Recieved notice that She needs to pick up my packet in Chisinau..

1/26 Sending Back Packet 3

2/16 Transit Visa to go to Romania for the Interview approved..

2/20 Leaves for Bucharest overnight drive by bus...

2/21 Medical

2/22 Interview !!!! APPROVED !!!!!

3/9 2007 Flight to me....

With only $5500, you shoud definitely get a co-sponsor. They dont care if you have $18 an hour, or $5. They care about what the total amount you make is. A bank statement is required always. The letter from your employer must state your annual earnings, not per hour rate.

but the last 2 years I made at least 25k/year with the same company . Only this year I dont make much because I spent most of the time with my girl in vietnam. I hope they understand the situation. when she goes to the interview i'm going to give her the last 3 pay stubs.

Your case seems really complicated, i advise you should find a good lawyer there or in Vietnam. Some how Cos have "red flag" on Vietkieu (we have to accept the truth) and if your finance is not strong enough that gains their doubt in your case.

August-17th-2007: Advance parole and EAD card recived (middle name on Advance parole paper was typo, mailed papers asking for correction to USCIS in Chicago, how annoying it is!)

September-04-2007: AOS interview, case pending for Security clearance (the game begins)

April-30-2008: Name check was clear, waiting for green card delivery(made 3 inform pass in April, May and June, my file was forgotten in the office where we were interviewed)

July-16-2008:Card production ordered

July-19-2008:Welcome letter received in mail

July-22-2008:Approval notice sent

July-23-2008:Green card arrived in mail

Thai Pham,

You need to find someone else to sponsor your fiancee for her visa.

You also need to resolve the apparent discrepancy between your W-2 form and the letter from your employer when adjustment of status rolls around - there's a big disconnect between working for 3 years at $18 per hour and earning only $5,500 per year. There's clearly some missing information that needs to be included.

You definitely need a co sponsor or a LARGE savings in your bank account. Regardless of how much you make an hour if you do not reached the 125% poverty guideline PER YEAR, it won't matter to them. I don't think a lawyer will help you much at this point in time...they'll just take your money and tell you the same thing here... Good luck!
