Hello everybody!

My finace and I are pretty confused on our case with the Affidavid of Support

and we need you help guys!

We noticed that to be a sponsor you need to have a particular

amount of income because they do not want me to recive any form

of

goverment aid while in America. He is a student and he is currently

receiving finacial aid under the his parents name. Since he cannot meet

the

requirements for minimum income we need a joint sponsor. If his mom is our

joint sponsor for the affidavit of support, would it affect our

appilcation(since his financial aid is under his parents name)?

I don't believe receiving any kind of financial aid has any effect on having a visa application approved. Just make sure that if he lives with his parents that he has them fill out an I-864A, the Household member form, and that his parents submit proof of relationship (birth certificates do this nicely). If he does not live with his parents, they can fill out an I-864 as a joint sponsor. In this case, the parent needs to submit proof of status -- that is, either a United States issued birth certificate or a Naturalization Cert. or a green card. Photocopies of all documents are accepted, just make sure the signatures on the Affidavit of Support forms are original!

THat is what I am doing as well. My mom is going to be our co-sponsor, though my financial aid is in my name. You just fill out 2 I-134 for the interview. One for you and one for your mom.

EAD/AP approved Nov 26 '07

Got the AP Dec. 3 '07

AOS interview Feb 7th (5 days after the 1 year anniversary of our K1 NOA1!

Stuck in FBI name checks...

Got the GC July '08

It sounds like your fiance's parents will act as co-sponsors. They should fill out the support forms just as he must. Also, they need to know that there is a possible 10 year commitment with this application. I think you will find out really quick if his parents approve of this arrangement. We'll keep our fingers crossed for you, for luck.

I don't think that his financial aid will be affected negatively. If he has much longer in school, it might even be increased because of your impending marriage.

Hehe, I'm sure hoping on that increase in aid ;) I'm just starting med school!!! 4 more years...

But i think i did not make myself clear - im not worried about whether he will get financial aid after we get married - im worried whether the fact that this is a government funding would affect our application....

I think may be not but wanted to check with u just to make sure...

Another thing i wanna ask you - I have been in the states on a student exchange program for the last 2 summers, but i have not filed my taxes yet...Do u think this could affect our application too?I know i might sound paranoic but i want everything to be ok so we do not get RFE(that was the abbreviation right?)

My husbands a student and recieve fiancial aid, his mom co-sponsered us and its all ok, I am now over here and married!

K-1 visa issued: 12/15/2006

107 days from mailing AOS package to receiving green card! Received 6/27/07 dated 6/20/07

I would like to ask something else anout the affidavid - how is the household size determined?

If for example the joint sponsor lives w the sponser his dad and his sister( they are above 21)are they considered towards the household size?thanks
