Can anyone tell me about a I864 affivadt form that needs to be filled out? is it different from a I134 form? We have filled out the 134 but now packet 4 is asking for the 864-what is the differnece? thank you

The I-864 is required only for those that have applied for an immigrant visa or are adjusting status in the US from a K visa. The I-134 when used in only one thing that a conof may use to determine if the applicant will or wont become a public charge and is not legally enforceable, unlike the I-864 which is more detailed and is legally enforceable. Look carefully at your paperwork, quite often the paperwork can be generic for the immigrant and K visas.

Our embassy asks for the I-864 as well, but then they end up taking the I-134. My suggestion is prepare BOTH and send BOTH to the interview. You can find the I-864 in the download section under adjustment of status forms.

9/11/07: Greencard in hand! (Day 73)
