How do we enter USA from Canada with approved IR-1 visa in passport ?

Hi all.

Our case for immigrant visa IR-1 is complete at NVC and we are waiting for Montreal interview.

We are trying to plan ahead for our travel back to the USA after we get the IR-1 visa in passport following the interview in Montreal. We are a family of 5 so flying will be expensive.

We will be heading from Canada to Florida and it is very expensive ($200 - $300 each one way) at this time of year to fly from Toronto to Florida but very very cheap ($89 one way each) to fly domestically from Buffalo Airport to Florida on Southwest Airlines.

Will it be OK to cross Canada / USA border at Buffalo/Niagara by rental car with IR-1 visa and then fly domestically from Buffalo to Florida ? Any possible issues to be aware of ?

Which POE point (bridge) at Buffalo would be best to use to activate I-551 ?

Any experience about which entry points will give the I-551 stamp in the passport upon entry ?

Moved to USA with K3 on 03/15/2005

I-130 filed to TSC with NOA1 on 04/28/2004

I-130 transferred from TSC to CSC 10/22/2004

I-130 received at CSC 11/04/2004

I-130 APPROVED 12/02/2004

NOA2 received on 12/03/2004

Case transferred to NVC on 12/13/2004

Received DS-3032 and I864 Fee bill from NVC on 12/27/2004

Waiting to meet I-864 requirements

Contacted NVC for a new DS-3032 and I-864 fee bill on 10/17/2006

NVC generated new DS-3032 and AOS Fee Bill on 10/30/2006

Received DS-3032 and AOS Fee Bill on 11/03/2006

Sent in Choice of Agent by e-mail on 11/06/2006

Mailed in AOS Fee Bill on 11/06/2006

Received IV Fee bill and mailed it back on 11/13/2006

Received I-864 packet and also DS-230 IV Packet on 12/10/2006

Got a new RCMP police certificate on 12/29/2006

Mailed NVC the I-864 and the DS-230 on 01/03/2007

USPS Tracking shows NVC recieved on 01/04/2007

NVC official received date from phone representative is 01/12/2007

Got RFE for spouse maiden name on DS230 on 01/20/2007

Mailed in corrected DS230 by overnight mail 01/24/2007

USPS Tracking shows NVC recieved on 01/25/2007

Case complete at NVC 02/14/2007

Waiting on Montreal interview date for IR-1 visa

Congratulations :)

There should be no trouble driving across and then flying, as long as you are able to find a one-way rental. There has been some discussion of this on the Canada forum recently.

I'm not sure about which entrance would be best - but any of them at Buffalo should be able to activate the IR1. If no one on has any suggestions for you here, definitely check out the Canada forum.

1/25/07 - approved ...NOA2 via snail mail - 1/29/07

03/16/07 - chose not to return packet 3 to Montreal

Timeline

No problem at all activating at a land crossing in a rental car and then flying from BUF. Once you're in the U.S. doesn't matter that you're dropping off the car across the border and hopping on a domestic flight. It's what I'll be doing with my K3 (aside from the flying, we're picking up a second rental car at BUF).

Look around for the cheapest place to rent a car one way. Most rental companies here I've learned do not charge an additional fee for this if you pickup in Toronto and drop off at BUF (going pretty much else in the U.S. with a one way from Toronto gets you a hefty $1,000 non-refundable drop off charge).

Actually I'd be interested in the best (i.e., not busy, knowledgable staff) crossing from Toronto to Buffalo as well. I'm going to post in the Canada forum about this. :)

2007-06-05: AOS interview letter date

2007-06-13: AOS interview letter received in mail

2007-07-03: EAD card production ordered

2007-07-07: EAD card received! (yay!)

2007-08-23: AOS interview (Documents / Interview review)

2007-08-23: Green card production ordered!!!

2007-08-24: Welcome notice mailed!

2007-08-27: Green card production ordered again... ?

2007-08-28: Welcome notice received!

Timeline

I came across awhile back (May 23 2005) but I had no problems at all.

I spent about 15-20minutes going through customs got asked a few questions got electronically finger printed and photographed and that was about it maybe a total 5min. The rest of it was waiting in line.

That was flying from Toronto to Texas.

130 Process:

June 25, 2004 - Mailed forms for 130 into Mesquite, Texas

June 29, 2004 - Mesquite got paperwork

July 2, 2004 - Received NOA from Mesquite (notice date: 6/29/2004)

October 29, 2004 - Our 130 was transferred from TSC to CSC

November 1, 2004 - Our 130 was "touched" today. My oldest said they were probably just brushing the pencil shavings off.

November 10, 2004 - Dee recieved the I-797C, NOA in the mail stating our case was transferred.

November 10, 2004 - Our 130 was "touched" once again today.

November 10, 2004 - Received 2 emails, less than a minute after midnight stating that on November 9th our 130 was received there for processing.

November 16, 2004 - Our 130 was "touched" again.

November 17, 2004 - Our 130 was "touched" yet again.

December 15, 2004 - An approval notice was mailed.

December 22, 2004 - NOA arrived in the mail today

NVC Process:

January 10, 2005 - Adam recieved a packet from NVC for choice of agent (DS-3032) with the case number. (Was dated 1/2/05)

January 11, 2005 - We recieved Affidavit of Support Fee Bill in mail.

January 19, 2005 - The 3032 was mailed in.

February 2, 2005 - The Affidavit of Support Fee Bill sent back in.

February 7, 2005 - IV Fee Bill received. (Dated: January 30, 2005)

129f Process:

July 12, 2004 - Sent paperwork for 129f to Chicago

July 15, 2004 - Chicago received paperwork

July 30, 2004 - Receieved NOA1 (notice date: 7/20/04)

August 2, 2004 - We can now check the status of our 129f online

September 16, 2004 - It shows that our 129f was "touched".

February 01, 2005 - 129f was touched again

February 3, 2005 - Received the NOA stating I have been

approved

February 12, 2005 - We received another NOA starting the K3 was approved with a date of 2/9/05.

February 17, 2005 - Dee received a letter (dated 2/15/05) from NVC stating they have received our 129f and within a week they will be forwarding it to Montreal and that I should be getting my packet soon.

February 17, 2005 - Received 2 emails stating the 129f was approved

February 23, 2005 - Received packet from the Montreal Consulate

April 11,2005 - Got appointment for May 20th :)
