Can't any of the pinned threads be merged?

I think the Pet thread gets a lot of attention and it would be a shame to see it drop down, but I agree this information needs to be somewhere it can be easily accessed.

I recently contacted the Embassy via telephone. Explained my situation fully. (violent ex)

I was told, i need not worry and did not need to take anything to the interview.

She did say, i may be asked a few questions. But to just answer, as i did on the telephone and the consular officer should be cool with that.

Packet 3 Received : 2010-02-17

Packet 3 Sent : 2010-05-20

Packet 4 Received : 2010-06-23

Booked into Norman Bates Hotel: 2010-07-29

Medical : 2010-07-29 (4 letters issued >.<)

Interview Date : 2010-07-30 (pending medical results)

Email from Embassy: 2010-10-22 They confirm they have medical results, we are under final review.

Courier website : 2010-11-2 shows packet enroute for delivery. 1st indication of final approval! Or is it??! argh the suspense!

Yep, I was told that too, however, I like to make sure I cover all my bases and have obtained it anyway. Even if they don't require it for the interview I think it's useful to have.

sorry can you just clarify this for me, due to you having an abusive x, you do not need consent from him? you do not need anything? can i ask does he have PR? Im going through similar situation just want to have all areas covered.

I broke up with my ex years ago. He was a very violent man towards me and my eldest daughter. There are police records proving this.

One night in particular he came to my home after we had broke up and kicked in my front door. 6 police officers dragged him out of my home that night.

I was forced due to death threats towards me and my daughter from him to move into a womens refuge. He wasnt too happy, we were talking to the police about the violence he had often bestowed onto us.

We were never married, he took me to court for access to both children. I fought it tooth and nail even to the point i was told by my solicitor if i didnt atleast agree to supervised access i would be in contempt.

After what this man did to my daughter hell would freeze over before i allowed anyone to sit her in a room with him. Supervised or not!

After two years of court appts he lost his case and he was denied all access to both children. (court records proving this)

I explained all the above to the Embassy lady and told her i currently live in a safe home...I want to keep it that way.

If i have any court records..she said to take. But she did say they do not ask for anything anyways. So it is entirely at the discretion of the consular officer.

I have no court records..But i can get. But even something as simple as proving i lived in a womens refuge etc may suffice the interviewer.

Or even the newspaper story..since it did hit my local press.

One things for sure i have NO intention of contacting my ex. As much as i love my fiance to pieces my safety and my childrens is paramount.

Im just being honest right from the off with the embassy and we will see in couple of months how it was for me and my family to get through this process without nudging the ex awake! >.<

I would advise anyone in any sort of domestic violence situation like mine was..to not do anything without speaking to the embassy first. They are there to help and assist...Let them!

Dont place yourself or your family in danger again.

I think this thread should be pinned!!!

Information such as this thread is vital to a speedy approval, yet the Embassy has no official guidelines for us.

I think it is wonderful the Embassy were understanding in the case of the violent ex, but I think you have MORe than enough evidence to prove why you a) have the right to take the kids and b) you can't ask him for permission!!!

09/17/2021 - Interview - decision cannot be made

11/24/2021 - Denial letter, 30 days to appeal

12/24/2021 - Appeal sent back with I-912 waiver

12/24/2021 - Motion to terminate deportation proceedings from 2013 filed

Thought i would update this thread on what happened to me yesterday at the Embassy Interview.

As expected the Consular Officer raised the subject of my son.

He is 16 and she explained about possible child abduction etc. I said thats fine i understand and i explained my story. All she said was "his father is on the birth certificate" and i went to on to say "well yup, because we were still together then, but broke up when my son was only a few months old. It was then i moved into a womens refuge"

I was asked for no proof but she did hand me an affidavit form

I had to write my name then my sons name and sign.

Then the Consular Officer witnessed and signed. The form is basically me declaring that i know of no court cases/ judgements where my ex is fighting for now or indeed has custody or access.

I think the end result was good for my case. I know its not nice to have a long gone past raked over the coals. But if you have suffered past domestic violence and the Visa process may awaken it, please speak up. Consular staff are there to help, let them :thumbs:

Timeline

Just wondering if my case sounds fine or not to anyone else.

My son: his father has no parental responsibility (not married when born, or ever, and only named as father on the birth certificate). He see's his son.

My daughter:father has parental responsibility jointly with me as we were married but he has NOT seen her for twelve of her thirteen years, nor pays maintenance. Mutual choice, mostly his :/

SO; I retained the services of a solicitor who has managed to get signatures from both fathers allowing my removal of the children to live in the U.S. The absent father took two times of asking over six months.

I am going to have the solicitor draw up a summary of how he got these two pieces of documentary evidence, which will hopefully formalise exactly WHAT they are and where they came from.

I will write a letter confirming my ex husbands behaviour during the marriage, and toward our daughter and outline that he has no continuing relationship with her, nor desire to have any.

I will retain the services of a public notary to witness, sign and stamp each of these pieces of evidence (they have said they will do so so long as I bring mine and my childrens passports along for proof of ID on the day). There is a flat fee of seventy pounds to sign up to four documents.

Does this sound enough evidence to the embassy? Surely even in the case of a parent having been married and having joint parental responsibility, if they sign consent for relocation of that child and it is witness (notarised) then that should be enough?

We got all the legal paperwork we could while in the UK, needed or not. This way once in the US it is easier to get stuff done. Imagine having to fly to the UK or send registered mail there to fix some simple mistake. No thanks, we did it the first time, it cost more but it is very worth it!

12-02-2011 - Mailed in AOS/EAD/AP paperwork.

12-05-2011 - Delivery confirmation per USPS.

12-27-2011 - (3) NOA I-797C received, dated 12-20-2011. Biometrics appt set.

01-10-2012 - Biometrics.

01-20-2012 - Notified of interview appointment for 2-21-2012.

01-31-2012 - EAD and AP approved.

02-08-2012 - EAD/AP card received.

02-21-2012 - AOS interview approved. EAD/AP card confiscated.

03-01-2012 - Green Card in hand!!!

364 days total time!
