Hello All!

My fiancée is planning to study after she arrives to states on K1 visa. Of course we will get married first. Will she be able to study here in college / university while on AOS process?

Any help :help: will be appreciated!

Yes she can go to school while waiting for AOS. Just give you a heads up, they may charge you a much higher tution fee since she will be consider a out of country student.

I suggest to wait until she gets her green card, and lived in the state thus you will not have to pay the out of country tution fees

To avoid out of country tution fees... does she have to wait for SSN or green card? Greencard takes typically 6months on K1 visa right?

I think she has to have roots in your state. Like getting a driver llicense/state ID, file taxes etc.. just maybe on year should be good..

It is up to you, I can't make you wait I just want to save you tons of money, more then 15% Like geico :lol::lol:

Or just call the school up and see what the requirments are :)

Timeline

Residency requirements apply as much to US citizens as it does to recent immigrants. There

is no discrimination outside of geographical location.

For example, my sister is a US citizen who lives in Arkansas, but is she wants to go to a school

in Florida instead, she would have to pay the out-of-state tuition prices for the Florida schools until she

can meet the 1 year residency requirement for Florida.

For tax purposes, if you live more than 6 months of a tax year in one location, I think that would meet a residency requirement per federal law but state laws may vary. So you would have to ask the specific college that you plan to attend to be sure.

different state has it's own timeline.. if you are in a big state like CA then it'll be short but like my state.. it takes roughly 2 years.

K-1 = 4 months

AOS = 5 months

I-751 = almost one year

Timeline

The best thing would be for her to go through community colleges - they are typically less expensive than state universities but it varies from college to college and state to state. She can then 'transfer' most of those credits to a university that she wants to graduate from later which she joins after a year or so of establishing residency and hence gets the state tution (avoid the out of state tution - they are very high.) Typically the admissions director can explain the requirements of meeting state tution eligibility. Just call or write to them. Good Luck
