bad luck with I-864 for the cr-1?

Hello All,

I mailed in the I-864 a little over a month ago. I havent heard anything back about it. Can this part of the process have a negative outcome? By that, I mean more than an RFE. What are some of the worst case scenarios? I may be more that likely scarred by the 221 (g) my husband received for the K-3. I just feel like "they" have it out for us. Can the I-864 be denied? Is it too soon?

I meet the income requirements and sent in the documents that go with that form.. I am just saying........ :unsure:

From what I understand that the I-129F for spouse and I-130 are processed separately - at least that's what happened with ours. It might just NVC is still processing the document - you might want to check NVC forum on how long it currently takes NVC to review I-864 as it varies from time to time.

Jun 28 2004 : Received at NSC

Oct 25 2004 : Transferred to CSC

Oct 29 2004 : Received at CSC

Nov 8 2004 : Received response from CSC that my file is being requested & review will be done

Nov 10 2004 : Email & online status Approved

Nov 15 2004 : NOA 2 in mail

Dec 16 2004 : NVC assigns case number

Dec 20 2004 : NVC sent DS 3032 to beneficiary, copy of DS 3032 & I-864 fee bill to petitioner

Jan 3 2005 : Petitioner received copy of DS 3032 and I-864 fee bill. Post-marked Dec 23rd.

Jan 11 2005 : Beneficiary received DS 3032 in Indonesia

Jan 31 2005 : Sent DS 3032 to NVC

Feb 8, 2005 : NVC received DS 3032

Feb 21, 2005 : IV fee generated

Feb 25, 2005 : Sent I-864 fee bill

Feb 28, 2005 : I-864 fee bill delivered to St Louis

Mar 3, 2005 : IV fee bill received

Mar 7, 2005 : Sent IV fee bill

Mar 9, 2005 : IV fee bill delivered to St Louis

Mar 28, 2005 : I-864 fee credited against case.

April 6, 2005 : Received I-864 package

April 7, 2005 : Immigrant Visa fee credited against case.

April 11, 2005 : DS 230 is generated

Aug 12, 2005 : I-864 & DS 230 received by NVC

Sep 14, 2005 : RFE on I-864

Nov 3, 2005 : Checklist response received at NVC

Nov 25, 2005 : Case completion

Dec 9, 2005 : Police Cert requested from the Netherlands

Jan 12 2006 : Interview success - Approved !!

Jan 19 2006 : Visa & brown envelope picked up

Since your K3 was returned to the USCIS, the NVC will (should) hault processing of your I-130 and will most likely return it to the USCIS office where it was originally filed. It will be up to the local service center after your K3 is reaffirmed of which approved petition to send to the consulate for a new interview...this happened to 2 members I know of with a returned K3.

I do know of 1 member who refiled their K3, it was approved and made it to the consulate...her and her husband are now reunited here in the states. I do however think what happened to them was a fluke, a glitch in the system...filing a new K3, getting approved and being issued a visa without having to rebut the first returned K3. If I remember correctly, their returned K3 could not be found, that is why they filed a new one.

I bet they do forward your K3 on to the consulate after it is reviewed and reaffirmed because of the new policy of retaining approved I-130s with an approved K3 in the mix.

Even if by some chance your approved I-130 made it to the consulate in Morocco and they scheduled an interview with your husband...they will tell him that they need a reaffirmation of the returned K3 from the USCIS before they can move forward with processing his visa application.

I hate to say it, but either way you are stuck in the return process until your K3 is reaffirmed by the USCIS. Please do not lose hope, you will make it through this process. Be patient, and stay strong.
