Timeline

My fiancee and I are getting married around summer of 2008. She has a son who will be sixteen this December. What do we need to do in order to get him authorization to work?

It kind of depends on his citizenship/residency status and which country you her and him will be living in!

Sorry I should have provided more detail...

I am the USC. My fiancee and her children live in Canada. They will be moving to the US to live with me. One of her sons will be sixteen, old enough to work in Arkansas, by the time she enters the country under the K-1 visa. So my question is:

Do we obtain his employment authorization for him separately; or

Will he receive employment authorization as my fiancee receives hers?

One more thing, but its off the topic:

I'm new to the forum and I may be missing it, but is there any way to edit the orignal post that starts each thread?

K-2 does not have EA incident to status, you will need to apply

As fwaguy said, the son will have to apply for work authorization. Another piece of advice, it is best for your fiancee (then wife) to submit the I765 along with her adjustment of status papers, if the I765 is submitted separately first, the employment authorization will expire at the same time as her original I94 (90 days) and will be a waste.

01/29/07 - DS230 generated (phone system not updated, email response 2/5/07)

02/05/07 - mailed DS-230 to NVC via express mail

02/20/07 - CASE COMPLETE!!

04/18/07 - INTERVIEW!!!! - APPROVED!!!!

09/28/06 - NOA1

1/25/07 - approved ...NOA2 via snail mail - 1/29/07

03/16/07 - chose not to return packet 3 to Montreal
