It says in the interview packet to provide the most recent tax return. Does this mean the 2004 return?? I have not filed mine.

And if I completed my I-864 on September 2005, I don't need a new one right? Because I-864 expres in 1 year

You will need the 2004 at a minimum. As the final day to submit tax returns is April 15, then one does not technically have to submit 2005 yet with the AOS if one doesnt have it. It is asking for your latest. A Conof is interested in present and future income more then past so any and all recent information is a must have. I imagine though that it is within a Conofs right to request 2005 if they feel it is warranted. The issue is different though when it comes to the poverty guidelines used...2006 is in effect as of March 1.

Are you not required to submit tax returns?

And correct.....the Affidavit of Support is valid for one year.

They will ask you to file your current three past years. ---2003. 2004, 2005--- If you don't have it by the time the pkg reaches the US Embassy abroad, I have heard of cases were they tell the beneficiary that the petitioner needs to go back and file current years and causes delay with visa issuance. Even if the I-864 has passed approval by the NVC. I have one question to ask you? If I am understanding you correctly your I-864 has already been approved, reviewed by the NVC? If this is the case, make sure that you send your up to date filed information to the beneficiary, and when they ask (the Embassy) he/she can pull them out. You should have time to file them before your cases reaches Embassy. It would not hurt to do another updated I-864 form and have it notarized with the updated information and give it to your beneficiary. Good Luck

April 4, 2005 IV Fee bill generated

April 15, 2005 IV Fee bill received in mail

April 16, 2005 mailed out 380.00 IV Fee bill regular US postail mail

April 25, 2005 I-864 form recieved in mail

April 25, 2005 Completed I-864 form mailed back to NVC

Thank you aussiwench & flygirlworld,

I am currently preparing my 2005 Return. It is very hard to prepare another I-864, especially that I have a cosponsor.

Hope an entirely new I-864 won't be asked for by the CO. Anyway, technically my I-864 is still valid (not even 1-year old).

Did anybody interviewed this month have any experience regarding being asked the 2005 Return?

26 January 2005 - Entered US as visitor from Canada.
16 May 2005 - Assembled health package, W2s.
27 June 2005 - Sent package off to Chicago lockbox.
28 June 2005 - Package received at Chicago lockbox.
11 July 2005 - RFE: cheques inappropriately placed.
18 July 2005 - NOA 1: I-485, I-131, I-765 received!
19 July 2005 - NOA 1: I-130 received!
24 August 2005 - Biometrics appointment (Naperville, IL).
25 August 2005 - AOS touched.
29 August 2005 - AP, EAD, I-485 touched.
15 September 2005 - AP and EAD approved!
03 February 2006 - SSN arrives (150 days later)
27 February 2006 - NOA 2: Interview for 27 April!!
27 April 2006 - AOS Interview, approved after 10 minutes!
19 May 2006 - 2 year conditional green card.
01 May 2008 - 10 year green card arrives.
09 December 2012 - Assembled N-400 package.
15 January 2013 - Sent package off to Phoenix.
28 January 2013 - RFE: signature missing.
06 February 2013 - NOA 1: N-400 received!
27 February 2013 - Biometrics appointment (Detroit, MI).
01 April 2013 - NOA 2: Interview assigned.

15 May 2013 - Naturalization Interview, approved after 15 minutes.

10 June 2013 - Naturalized.

I asked the Embassy in London the same question this is a copy of the email reply they sent me, I know different countries do it different but it may help!!...........My interview date is April 28th

Your husband is not required to provide you with his 2005 tax returns. The Immigrant Visa Unit allow a grace period between the end of the tax year and the date petitioners are required to present the latest tax return.

April/04/2005- Visa journey began!!

We did both K3 & CR1 visa's, got both!!- I returned to England for my CR1 interview after first arriving on a K3 visa!!

May/25th 2006- Green card arrives in the mail................YAY!!

19th June 2006 I Had to go to the Social Security Office to get my number, the DS-230 didnt work for me!!

26-June-2006- Social Security# arrived in the mail....YAY!!

Feb 2008 lift conditions <<<reminder to self!!<<<< went to England for a visit instead, no rush right, 90 days is a long time,LOL

Removing Conditions Begins

Mailed I-751 April 12th 2008

signed for @ NSC April 16th

NOA date April 16th

Conditional GC expired May 5th 2008

Biometrics Detroit May 10th 2008

10 year Green card ordered August 20th 2008

Citizenship any time from feb 2009
