i-129F RFE: Marriage termination document but no marriage took place. Help!

Hey everyone.

Last week I got an RFE requesting a termination of marriage document which got me confused because no marriage has ever took place.

Here's what happened -- In 2005,I filed a i-129F for my former fiancée. It was approved and was sent to the US Embassy to her country. Unfortunately, she got pregnant with another man's child. She ended the relationship because she said is was too embarrased of she has done. Long story short, I moved on. Never heard from her since. And never took any action for the petition I filed for her thinking it would expire in time.

9 years after, on June 2014 I filed a i-129F for my present fiancée without any worries that my previous petition with the former fiancée would actually be of any problem.

My question is: Do I need to write a letter of withdrawal of the 9 year old petition to the US Embassy of the former fiancée's country? Or just send the USCIS proof that no marriage took place between me and former fiancée?

Hope someone can help me with this.

I think you are going to need to write a letter to the USCIS and explain what happened with the previous relationship. Also, the previous petition has expired... The USCIS just wants either divorce paperwork or, in your case, an explanation. Others may not share my thoughts...

It seems a little weird that your previous petition would be what they are looking at.

First of all because on your current petition don't they ask if you have ever filed a petition for another person and what was the outcome of that petition.

Secondly there was never a k-1 visa issued to your former fiancée making it impossible for you to marry under the k-1 guidelines.

You should write a letter stating that you are withdrawing your previous K1 Visa if you still have your case .IF not meet with someone in person to explain that cause .They might not take your explanation on the letter.
