can i leave on a K1 visa and still keep a mortagaged house back home?

Hi,

I'm going through the K1 visa application atm and am just waiting for the interview to be scheduled. I was wondering if anyone else has been in the same situation as I. I have a house with a mortgage on it that I am planning to rent out whilst I live in the sates. Is this acceptable seeing as I will be mirgrating to the US to live with my wife. Has anyone gone to the US and kept properties back home?

If anyone could shed some light about this situation as I wouldn't want anything holding me back whilst in the process of migrating to be with my wife.

Hi,

Yes. You can keep whatever property you wish. There is no requirement that you have to sell or give up property in your country in order to live here.

Just be aware that if you receive any rental income or have other foreign assets, income, or accounts you may be required to report them to the IRS when you file your taxes.

Yes, keeping it is perfectly fine.

You should probably practice calling her your fiancee and not your wife, specially since you're about to do your interview.

Also, I'd recommend contacting several contracting companies, plumbers, electricians, and landscapers in the area and set up contracts with them to maintain the home. You can also rent your home as a vacation rental, if you contact a real estate or search online for a company who rents out apartments/houses for vacation rentals you can set up a contract with them, most of them already have maintenance workers. They can handle the day-to-day management of your home.

You'll want to make sure that despite your absence you're still following any landlord-tenant laws, and that your property is not being mistreated.
