AOS: I-693 QUESTION

Hi guys,

I got here in United States last July 14 and we're planning to get married on the 18th of this month. The validity of my I-94 is until October 11. So we are planning to submit my AOS application probably on the first week of October. By the way, do we really need to file the AOS before my I-94 expires?

Also, I want to ask if I still need to see a Civil Surgeon and submit I-693 for the AOS? I am looking at the Copy of Vaccination Documentation Worksheet, Form DS-3025 that they gave me during my medical exam. I had my medical exam last March 27, 2014. They gave me only two vaccine shots during my medical cause I have a history of varicella when I was a kid (chickenpox) . And on the result field there's a check mark on the box for __ Vacinne History Incomplete and under that there's a check mark that says "Applicant may be eligible for blanket waiver(s) because vaccination(s) not medical appropriate (As indicated above)

Can someone please enlighten me about this. :help:

03-14-2015: Arrived at Post Office Chicago, IL; USCIS closed since it was Saturday

03-16-2015: AOS Packet DELIVERED

03-23-2015: Text/ Email Notification: Notice of Acceptance

03-28-2015: NOA1 for AOS, AP & EAD received in the mail

04-03-2015: Notice of Appointment for Biometrics on the 14th of April at 11 a.m

04-10-2015: Biometrics taken (walk-in)

06-08-2015: EAD Approval Notice received in the mail

06-10-2015: EAD/AP in hand

06-25-2015: Received Notice of Potential Interview Waiver Case in the mail

No, there is nothing stipulating you have to file AOS before the I-94 expires, but "officially" you are out of status once it does.

Page 4 section 7c of the I-485 instructions state you only need to submit a copy of the vaccination record - I suggest if you send in a copy of the DS-3025 that you attach a copy of page 4 with section 7c highlighted of the instructions, others have done that and had no issue using just the DS-3025.

No, there is nothing stipulating you have to file AOS before the I-94 expires, but "officially" you are out of status once it does.

Page 4 section 7c of the I-485 instructions state you only need to submit a copy of the vaccination record - I suggest if you send in a copy of the DS-3025 that you attach a copy of page 4 with section 7c highlighted of the instructions, others have done that and had no issue using just the DS-3025.

So it still more ideal if we submit our AOS application before my I-94 expires to avoid any issues, right?

Do you have the link of that specific that I-485 instruction so I can save it.

To add to this, you can file your AOS after your I-94 expires and as Hank points out you are technical "out of status", but also keep in mind that you need to file your AOS before your medical expires or you need to do the medical over again. It seems that you should file a few months before your medical expires, at the latest, as I have read of some people getting RFEs during AOS processing because their medical expired. Always best to be safe than sorry in my opinion.

To add to this, you can file your AOS after your I-94 expires and as Hank points out you are technical "out of status", but also keep in mind that you need to file your AOS before your medical expires or you need to do the medical over again. It seems that you should file a few months before your medical expires, at the latest, as I have read of some people getting RFEs during AOS processing because their medical expired. Always best to be safe than sorry in my opinion.
