Hello everyone

I need to ask for my sister

she just filed based on the 5 year residency rule, and has a child who is an LPR as well -

if she successfully acquires citizenship before my niece turns 18 next year, does the child automatically become a citizen?

my niece was born in Kuwait - my sister divorced her father many years ago who is a kuwaiti national after long term abuse and came to the US - and was remarried which is how they both acquired the green card

does it all add up?

So, just to get things clear, mom and child lived in Kuwait. Mom divorced Dad and then filed I-129F and both mom and child came to the USA, mom got married to USA citizen and is now filing for citizenship.

If the above is the case she could have filed two years ago as if you come down on an I-129F and you get CPR(Conditional Premanent Residence) 2 year GC and then get the 10 year. Irregardless, I am 99% positive that if mom is granted US Citizenship that child will be automatically a US Citizen as well. I will leave it to others to correct me if I am wrong.

If the child is a green card holder and still under 18 at the time mom acquires citizenship, she automatically becomes a citizen too.

Actually she could not have filed any earlier, since she got divorced from her US husband

but thank you for the insight - she is a green card holder, so its a matter of when her naturalization becomes official if it approved
