CFO Parental advice needed?

We've made it this far and my fiancee has her interview next month!

But I have a question about the CFO and the parental advice (sometimes?) asked for when beneficiary is 21-25. I've searched the forums and can't find anything about this.

After reading the Family Code of the Philippines which relates to this requirement, the way it reads it should not even apply because the marriage is not being contracted in Philippines:

Article 15

Any contracting party between the age of twenty-one and twenty-five shall be obliged to ask their parents or guardian for advice upon the intended marriage. If they do not obtain such advice, or if it be unfavorable, the marriage license shall not be issued till after three months following the completion of the publication of the application therefor. A sworn statement by the contracting parties to the effect that such advice has been sought, together with the written advice given, if any, shall be attached to the application for marriage license. Should the parents or guardian refuse to give any advice, this fact shall be stated in the sworn statement. (62a)

We are a same sex couple, so the marriage could not be contracted in Phils anyway. So is parental advice still necessary for CFO?

The problem is it would be difficult to obtain for a couple reasons, mostly being that her parents live in the province, far from her, so she would have to travel far just to get them to sign a paper.

Any advice would be much appreciated – especially from another same sex couple!

CFO could ask for the letter. She doesn't have to go to the province, just ask her parents to go to a lawyer in their area, have him draft the affidavit of parental advice, notarize it, and have them send it to her before her interview.

Thanks both. I understand there is a form, but being that Phils would not recognize our marriage anyway, is it really so necessary? They could ask for it? What if my fiancee's parents do not approve of her lifestyle and won't even talk to her, are we just dead in the water?
