Hi,

I was just wondering if you have got an experience - sending letter to your congressperson when filing for the K-1. We have already been waiting for our NOA2 for more than 4 months and cannot get an answer from the CSC why it is taking so long. We would like to know the reason for the delay as it is very painful not knowing what is going on with our petition We tried to contact the CSC by email and by the phone but never got a clear answer. They didnt even replied to the last email we sent them last week. Also it is very frustrating to see that the processing time is Dec 31 and people who filed two months later already got their NOA2.

We decided to write a letter to our congresswoman as we would like to find out more information about our petition and the delay.

Have you done that? What was the response from the congressperson? How long does it take for them to contact the service center? ......

Any experience would be appreciated, we are really curious if the congressperson can help us.

Thank you.

I contacted both of my senators and my representative when our K-1 got stalled (at the consulate level). Unfortunately I no longer have the letters I sent, but I included my name, SSN, DOB, as well as my fiance's name, DOB, A# (I think it's on the NOA1, though perhaps only on the NOA2, I'm not sure), and a brief description of the case so far. You need to send them something in writing stating that you authorize them to inquire on your behalf (basically, the last sentence or two of your letter stating this, followed by your signature, should suffice); all of the people I contacted had the correct wording on their websites in the area regarding immigration issues, so check their websites. They have to have that written authorization before they do anything.

I would suggest that you send off a few letters (or fax them) and call to follow-up. My senators and reps did nothing for me without major prompting on my part. One of the offices I contacted didn't get back to me until almost 2 months after I sent in my initial request. So definitely you will probably have to bug them.

They may not get answers for you right away, but at least you'll have something else in the works.

Good luck. Hopefully it will resolve itself without the need for congressional intervention.

I called my congressman when my case was outside of Vermont processing times. He made a call, and I received a letter from USCIS within days, telling us the background investigation was still being completed.

If you are outside the processing times I would call and they will open a "referral", which is an investigation. If your congressman calls theywill do the same thing. Bottom line-If you feel that you have been waiting too long-call. If you are not 30 days outside of processing times-they won't do anything for you. If it makes you feel any better I filed 12/8 and watched people get approved in days-I waited almost 90 days, which is very unusual for Vermont, but I finally got my Noa2 the other day.

Good Luck to you!!!

Forgot to mention, I called my congressman on a Thurs-he called me back Friday with a response-he was great!!!!!

Hi, we too had a long anguishing way with Nebraska and my fiance at the time wrote to her congresswoman

who had to write back to my fiance for an approval letter to indicate she was working on her behalf before she contacted Nebraska. My fiance waited 2 weeks and got back in touch with the congress woman who told her she had no reply from Nebraska, then I phoned the congress woman myself a couple of times stating our anxiety, frustration, and indeed the unjust way they process these papers, about a week after that the congress woman got a letter stating it was still going through extra security checks, she forwarded a copy of the letter to my fiance, 2 weeks after it we got our approval.

Regards David

JanaStepho,

I think writing to congress person is a good idea.. I had filled for my fiancee back in august 05 and just received our NOA2 1 day shy of 6months.. it was a long ordeal and CSC kept saying that required background security checks are still pending. However a lot of us who had filled to CSC around end of August got stuck in security checks. So we had a support group to vent out...

I first wrote a letter and emailed that to my congresswoman, then called the next day and spoke to her assistant. Her assistant sent an inquiry to CSC and then the waiting game again. She got a reply from CSC saying that they have recvd her query and will reply in 30 days. Well 30 days past by and i asked her to followup again.

4 days later we got our NOA2... However the most funny thing was - my congresswomans office had no idea or information fwded from CSC till then. I called her to thank her for their efforts and she was like humm i haven't heard a word from CSC yet.. :)) funny huh..

Having said this, i don't want to lower ur morale. u need to contact these people and have them chase ur case.. I am not sure if it makes any difference or not, but atleast you will feel that u are doing all possible and are not leaving any stone unturned.. Waiting those 6months and see others get their NOA2 within record times can be very frustating and painful.. so this way u can channelise ur mind into a more constructive manner. I called the congress office every week in that time, just to try my luck and some to make that office understand the seriousness of the issue...

All the best and make use of this time to read online about the process and gather papers etc that u will need for interview etc..

Regards,

Pksang.

thanks for the great response, that makes me feel a bit better that it might help....we just dont want to be sitting and doing nothing, we dont even know yet if they do backroundchecks on our case or what....well I guess they probably do but I want to hear it from them, to be sure, that our case folder wasnt lost or misplaced or anything else...

hopefully we will find that out soon

Thank you for the support.
