I-129F with slight (but good) complication

Hi-

I spent several minutes browsing the VJ forums in an attempt to find the best place to post, and settled on this sub-forum. Hope that is ok.

I have a Russian fiancee who lives in Moscow. Today we learned that she is pregnant. It's wonderful news to both of us, but now I am quite confused about how to approach bringing her to TEXAS. I had planned on a vanilla I-129F. I asked that she get all of the background information that we'd need, but hadn't logged on to VJ yet to get processing times and heck....even where to file the petition now; it seems like it changes periodically. With the pregnancy issue looming, I had thought of filing an I-129F K-3 ... I seem to recall that this is the variant that would allow your beneficiary to bring their child, correct? But of course we don't know anything about the child yet (and there can always be complications...let's hope not!) so I don't know what to do there either.

Please, any help would be much appreciated. She sent me a picture of the ultrasound today and I must admit to being ecstatic!

Thanks SO much!

ps-The timeline shown below is old, obviously. I tried to delete it but couldn't figure out how. Olga ended up dumping me prior to the interview and married a local guy, so that didn't work out. Anyway, old news. Life went on...thanks

You will proceed with the I-129f since she is your fiancé. If you meet the requirements to transmit US citizenship to the child (which you probably do) she will file for a CRBA (consular report of birth abroad) which will result in the child receiving US citizenship and then apply for a US passport.

Hi Belinda,

Ok thank you for the feedback. So I just file the I-129F K-1 like I was planning on initially, correct? And then once our child is born, she files for a CRBA in Moscow. Then we'd need to get a US Passport. Hmmmmmm....I wonder how long getting the passport might require? Oh well I can jump off of that bridge when I get there. Yes, I was born and raised in TEXAS, so I am a US Citizen by birth, which (from what I understand - correct me if I am wrong) means that any child of mine who is born abroad is also a US Citizen. Yes?

Thanks so much!
