Thanks for the heads up! I definietly will send the email, although my guess is we will get a checklist for it anyway!

So listen to this! I called this AM on the way to work and spoke with Briell (sp?) and asked if my AOS or DS-261 had been reviewed (I am at 35 calendar days from the DS-261 and 25 business days). She said I have to allow up to 60 days for the AOS but then she said "But your DS-261 should have been reviewed by now so I'm going to go ahead and pass this onto a supervisor. They should review it and then release the IV fee."

Say wha'?!?! She OFFERED to pass it to a supervisor and it hasn't even been 30 business days yet! Well I'm not complaining, and I'm not holding my breath either. But maybe, just maybe it'll help!

I have a question;

How do they count the 30 days, cuz ur date says the 17th. Shouldn't ur 30 days already be up? Or do they not count weekends??

Well it depends on what we're talking about. The reps will say "30 business days" or "60 days". That means its like 45-60 days. When calculating business days you can't count weekends or US holidays. There is a calculator but I just go from my start date (which is actually the 18th (submitted 17th, "received" 18th) and then go to the same day of the week on the next week and count 5 business days for each week. 5-10-15...and so on each week. So I am about 35-36 calendar days and 25 business days today. Don't know why she said it should have been reviewed already,but I'll take it!

I believe jsumner already answered this, but the answer would still be "no".

From jsumner: "It will still be no. Your spouse is a US citizen, they don't "immigrate" or get a special visa to live there.. They simply just move back. ;) Plus the other answer would be no as well.. Because in the DS260 or the I-130, one of those.. the requirements is your spouse has to be back in the states before or the same day the immigrant arrives to the US. "

How does the NVC expect to clear this backlog?

They use to be 2-3 weeks. Not they are 2 months soon it could be come 4-6 months.

After my second checklist (just sent documents ovenight today) I am wondering if these wait times will become permanent?

I wanted to weigh in on this question in the DS-260. I am living with my spouse in Chile and I've been abundantly clear on all the forms, supporting documents, and cover letters that I'm living here with the intention to do so until my spouse is approved for his permanent residency. Yes, the whole AOS process is searching for domicile (I think it's the I-864, not the DS-260 or the I-130 that requires the sponsor to be domiciled in the US) and therefore wouldn't necessitate an immigration for a USC "back" to their country of domicile, but I still answered that question yes. I asked the embassy here and they informed me that I should write yes - it's not normally a cause for a checklist, but they might clarify it at the interview. I've read it both ways on the forums, but I haven't seen anyone receive a checklist for answering that question incorrectly - but maybe I haven't looked hard enough.

That's just my two cents and what I was told from the embassy. I didn't bother calling NVC because I knew I would probably receive confused silence followed by whatever the operator was feeling like saying that day. Anyway, I guess i'd suggest checking with the NVC and embassy!

That's a good point. It is a little confusing how they word the questions on the DS-260 when asking about immigrating with your spouse. Like you said, I am sure it's something that can be explained at the interview.

I am in a similar situation as you, whereas we won't be moving to the U.S. until my spouse is approved also. :)

Concerning the questions on the DS-260 about if the spouse is immigrating to the US:

For IR-1/CR-1 visa applicants, the spouse of the beneficiary is the petitioner, and the petitioner is a US citizen. No matter if the US citizen is living in the US or in another country, the answer to BOTH questions will be no. There is a huge difference between immigrating and simply moving back. A US citizen doesn't immigrate to the US, they just move back. Immigration involves getting a visa.

Remember, this form is not only used for IR-1/CR-1 applicants, such as most of you here. It's also used in cases where the spouse is also a beneficiary, thus immigrating as well.

Hi, everybody.

I received a Case Complete e-mail from NVC today so I wanted to come here and give some info to all of those who are still waiting. I know I was always interested in other people's timelines.

My case landed in NVC on April 7th. We had a RFE in June. I called yesterday (Aug 21st) and found out our case was completed on Aug 15h. I called because my AOS Fee on the website became N/A. Today I received an email notifying me of my case being complete. I am filing from Croatia, so there is no EP.

My case was at NVC for 130 days. Before that, we waited for NOA2 for 267 days. Now we are waiting for an Oct interview date, which I will have to reschedule due to my trip.

Anyways, good luck to everyone who is still waiting. As unlikely as it seems to you today, there is an end to this part of the journey. Keep your sanity! :)
