Laurel Scott Chat Log 8/6/2014

Laurel: Good morning everyone.

Laurel: The big update at the moment is that the NVC is finally admitting that it is overwhelmed. The agency is now sending notices to everyone stating that their response time is 60 days from the date they receive any document, inquiry, or form. While this newly announced response time is frustrating, it hopefully indicates that the NVC will be more careful about reviewing files before sending requests for evidence (RFE). The American Immigration Lawyers Association (AILA) is in the midst of putting together an assessment of attorney complaints regarding the NVC. The NVC has had a long history of sending RFEs for documents that were already submitting and do not describe what, if any, problem there was with the already-submitted documents, BUT recently the frequency with which this occurs has skyrocketted. AILA does not put together assessments of attorney complaints unless there is a spike in problems, so AILA's actions indicate unusual, widespread problems at the NVC.

Laurel: The best advice for people going through NVC processing is to expect for it to take several months and not to be surprised if you get an RFE for a document that was already submitted. In the past NVC processing would normally take one to three months. You should now expect for it to take three to seven months. This may present problems for people from countries that require a police certificate as it is possible that your police certificate will expire while your case is pending at the NVC and you will have to get another

Also, the subject of the interview letter email is: MTL XXXXXX (STD P4 APP (24JUN2013))

I wonder if this means they are assessing files from Jun 24th?? I had resubmitted my AOS around that time.

It says June 24 2013. Everyone's interview letter subject has the same thing; it's probably the date that email form was first created. Definitely not related to your case though :)

I am shaking, and crying. I just spoke to an operator and my document has not been reviewed. I explained I am at day 60 and what happens now and she said I have to wait a bit longer. I asked to speak to a supervisor, was put on hold and she came back to explain no supervisor was available.

She also tried to tell me that since my doc was received on 16th June and today is 15th Aug that 60 days is actually tomorrow. I said, "no there are 31 days in July to 60 days is today". she said "no, it is not". Ok, so NVC days are different than human days apparently.

She said I will "definitely" hear next week. That the NVC is "working overtime, 7 days a week, 12 hour days to catch up on all of mail". I laughed out loud and said I don't believe her, all I have heard in 5 months is lies and she said "Yah, I'm lyin' to you" and hung up on me.

I cannot do this anymore.

Aww I am so sorry, please don't be upset over this. You know how they all hate their jobs and never want to help :( just relax and take your mins off of it for the weekend and call back on monday. If you get a rude rep, just hang up and call back again. Next time just ask to speak with Sylvia. Also, if you call early in the morning reps are somewhat nice. As the day passes, they all become ruthless.

I had the same thing happen to me while I was waiting for my IV fee invoice. I waited way more than 60 days for it to become available and was told a different story by each of the reps. Don't let it get to you, stay positive. :)

The rep told me "ma'am if you think we're lying to you then you're better off not calling." I was like then what am I suppose to do? She's like "please pait patiently." I was like yea sure easy for you to say.

Done. What a pity it's only the USCIS stage.

Amanda :( I'm so sorry.

Thank you both. I just don't know why my file has been missed and there is nothing I can do but wait. It's just a shame that my whole life I have been a "wait my turn, have patience, good things come to those who wait" sort of person, but now I have lost all trust in the system.

I do definitely realise it could be so much worse if I lived in a horrible place or was separated from my spouse, etc. But, at the same time I have waited for my turn and it's like everyone is cutting in line (obviously not their fault, so I don't blame anyone who is getting reviewed before me).

What makes it worse for me is the constant lies the NVC operators feed me to get me off the line. Today I was told they most definitely review mail in order received, and when I asked why people with later scan dates were being reviewed she said something about different cases take different times. I then asked why if mine was only a checklist it wouldn't take less time. She then said they don't know what is in the envelopes before they start to review them. So, she totally contradicted herself. If they went in order, mine would take less time than say a brand new AOS package.

Lies, lies, lies.

Thanks Austin. I was really hoping I would wake up to a CC today. I had vivid dreams about it last night including some magical NVC spread sheet where I saw my name with a big #1 next to it for my file to be the next in line for review. Of course I would love a Sept interview, but my nightmare will just end when I am done with NVC. I just still don't know if they have accepted all of my documents and the worry over that is what is killing me. If I get another checklist I will be so shattered.

Thanks for your kind words. I wish I could control my emotions enough to not be upset, but unfortunately I can't. I will just have to do my best to keep myself busy and wait. I don't know why I bother to call them at all, but I guess just in hopes I had a CC and my AOS fee didn't change for some reason.
