Living with fiance in her home country during application process

Timeline

Hello, my fiance lives in Vietnam and I am submitting the i-139f application in the next couple of days, I was wondering if it is possible to go back to Vietnam and stay the entire 6-12 months or however long it takes for everything to go through and she can get her K1 visa and we come to the usa together?

My employer has said they will give me a 1 year leave of absence if needed and I have someone lined up to maintain my home while I am gone.

My fiance even has a job lined up for me if I can go.

Is it possible to do this and what steps would i need to take to make this happen?

The only info I could find on this someone said I must contact the IRS but outside of that I have not found any solid info and it's difficult to talk to a live person at the uscis.

Yes, you can stay with your fiance during the process and depends how long it takes. If your application is processing at CSC, expecting your I-129F's approval faster. Also, do not forget to read review about the US embassy in Ho Chi Minh to give you an idea how long they process K-1 visa. As long as you can support your fiance(e) and above poverty guidelines for I-134, you both should be just fine even if you live with your fiance in Vietnam for some certain periods.

Thank you for the info, on the topic of being able to support my fiance above poverty guidelines are you referring to supporting her when she comes to the usa or supporting her while I am in Vietnam? I know she has a job lined up for me but I honestly have no idea how much the pay is according to poverty guidelines, I do know she makes very good money at her job, more than enough to support us both but I don't want her to do all the work while I am there :-)

I would say you have to prepare for adjust of status as well (I-485) after she married you within 90 days. I have no idea how to calculate poverty guidelines for I-134 though. Let's others chime in about this. You need to demonstrate to the US embassy in Ho Chi Minh that you are be able to support your fiancee for K-1 visa.

For the I-134, you have to show that you earn 100% of the poverty rate for two people (a shade under $19k I believe). That's usually done via a copy of your most recent tax return and pay stubs. If you move to Vietnam, the latter might be more problematic but maybe a letter from your employer would help, as would be evidence of any assets you have. If you don't have sufficient assets and your Vietnam pay is less than the US poverty rate, then you could find a co-sponsor too I think.

As for contacting the IRS, you just have to file a form if you earn income outside the usa for a certain time period of the year. You won't owe any income tax on that income up to a certain amount (used to be around $85K/year, not sure what it is now). It is unrelated to the K-1 visa process.
