I-864? RECEIVED CHECK LIST PLEASE HELP!!!

Hi,

I'd received a checklist from NVC regarding AOS as below:

In Part 3, Information on the Immigrant(s) You are sponsoring, please correct the following...

[x] Items 2 through 6.f. This case's visa category does not allow accompanying family members; therefore, you cannot

list family members in this section.

[x] Item 7. The total number of immigrants listed in Item 7 must equal the number of immigrants listed in Part 3, Items

1 through 6.f. In addition, you must also verify that the total number of immigrants listed in Item 7 matches the

number you entered in Part 5 Item1

In Part 5. Sponsor's Household Size, please correct the following...

[x] Item 1. The number of sponsored persons must match the number listed in Part 3, Item 7

I'm sponsoring for my husband and his daughter ( I do have a son who lives with me). I'd filed only one AOS initially with my step daughter's info in PART 3. But per the check list received, it states I don't have to include family members in this section. Does that mean I need to file a separate AOS for her. If so, do I need to include my husband and my son's info in her form to indicate household size as 4- me, my son, my husband and his daughter?

Also regarding sponsor's household size- do I need to include my stepdaughter along with my son and my husband on the corrected AOS form (PART 5 ITEM 5) so that the total Household size be 4.

This is very confusing. please help!!!!

April 22, 2011: Mailed I-130 to Chicago
April 28, 2011: Received NOA1 via text/email, file routed to CSC (priority date April 25th)
April 29, 2011: Updated
May 3, 2011: Received NOA1 hardcopy in mail
July 26, 2011: Received NOA2 via text/email!!!
July 30, 2011: Received NOA2 hardcopy in mail
August 8, 2011: NVC received file
September 1, 2011: NVC case number assigned
September 2, 2011: AOS invoice received, OPTIN email for EP sent
September 7, 2011: Paid AOS bill (payment portal showed PAID on September 9, 2011)
September 8, 2011: OPTIN email accepted, GZO number assigned
September 10, 2011: Emailed AOS package
September 12, 2011: IV bill invoiced
September 13, 2011: Paid IV bill (payment portal showed PAID on September 14, 2011)
September 14, 2011: Emailed IV package
October 3, 2011: Emailed checklist response (checklist generated due to typo on Form DS-230)
October 6, 2011: Case complete at NVC
November 10, 2011: Interview - APPROVED!!!
December 7, 2011: POE - Sea-Tac Airport

September 17, 2013: Mailed I-751 to CSC

September 23, 2013: Received NOA1 in mail (receipt date September 19th)

October 16, 2013: Biometrics Appointment

January 28, 2014: Production of new Green Card ordered

February 3, 2014: New Green Card received; done with USCIS until fall of 2023*

December 18, 2023:  Filed I-90 to renew Green Card

December 21, 2023:  Production of new Green Card ordered - will be seeing USCIS again every 10 years for renewal

Each petition needs it's own AOS. I assume you filed an I-130 petition for each person that is coming to the USA who is not a US citizen?

As for your spouse's form, you would include your spouse as the immigrant and any natural born children and/or other dependents on that form. Do not include the stepdaughter on the spouse's AOS

On the step-daughter's AOS you would include the step daughter as the immigrant, your spouse and any natural born children and/or other dependents.

So the household size on your spouse's form would be one less than the step-daughter's form. Don't worry, that is the way you are supposed to do it.
