Does past tourist visa denial affect current K1 application? (merged)

Timeline

I applied for a tourist visa last 2012 to visit my girlfriend and her family back then. I was denied based on not being able to establish "ties". In short was not able to establish that i will come back. Of course thats not true. Now my fiance (girlfriend back then) applied for K1 visa to finally end this long distance affair.. I was honest and wrote in the ds160 about my denial 2 years ago. Question, will the consul turn back the past denial and use against me not to be approved again?

No.

Not if it was for your inability to convince the CO during that interview that you would return which is the idea that you state. Your K1 visa will stand on its own merits meaning the documents and your answers to the CO's questions, must prove to them that your relationship is valid. If you can prove that you have a relationship and it has been ongoing then you should not have any problems.

My husband was denied a tourist visa for the same reason two years ago when we were dating. During the interview for his immigrant visa (we did DCF in Seoul) the consular officer asked him about this and after he explained she apologized for the inconvenience it must have caused us. Don't worry as long as you are honest!

Thanks for your feedback. At least We only have one problem. The admission to the doctor at st lukes that I have once tried marijuana during my college years. I really hope everything goes well in the interview. Im expecting for the worst. I hope its just a 1 year ban. Straight approval would be a miracle.

No! As long as you are going to be with the same person that you want to go and meet when you are denied. if it is a different person that filled for you now, then that might be some issues. The same thing happened to me, I was honest about it and the rest was history. Goodluck

As long as you didn't fudge any other questions you should be fine. Some people will claim spouses that don't exist thinking they show ties and then need to show that they are divorced from the non existing spouse to get a marriage based visa in the future.

This will not be over quickly. You will not enjoy this.

I was denied tourist visa twice in 2009. I also DID NOT conceal it and I explained it was due to 214 (b) 'ties' on ds160. The Visa Officer didn't ask anything about it. After my interview last July 23rd, I asked the VO if im approved, he smiled and said 'YES! Congratulations, good luck!'

Now waiting for my visa packet to arrive! Hope it wont take long. ??????
