Hello,

I have a question that I hope someone will be able to answer. It looks like we will need an extension beyond the four months to complete the medical/interview. I have read on Visajourney that, when an extension is requested, the Consulate will give another four month extension. We would need only about a month or two to get everything completed, not the full four months. In fact, waiting the full four months could cut into the date we need to be moved by.

My question is, when you do get an extension, are you able to get the medical, notify the Consulate and request an interview date some time during the extended period? Or do they send you an interview date whenever, which is closer to the end of the extended period?

Welcome to the forum.

Good question. A consular official can extend the validity of the approved petition if it expires prior to completion of the visa processing. There is no mention of a specific time period, nor is it mentioned that the processing will only take place at the end of the extension. It sounds like someone is a bit confused, or over-thinking the process a bit. Refer to the DOS Nonimmigrant Visa for Fiancé(e) (K1) FAQs for actual information about the topic. Another good source for this information would be the interviewing consulate.

My petition expired in June, but I did my medical and interview in July because I couldn't get time off work (and had to travel across the country for it). The expiry date on the NOA2 isn't something to be too concerned about - and yes, they do extend it for another four months at the interview, as they did with mine. I did email my consulate prior to the expiration date just to double check and they replied:

Dear Melissa,

No worries. When you appear for your visa interview in July 2014, the consular officer will automatically revalidate your petition for a period of another 4 months.

You could always contact your specific consulate about it for your own peace of mind.

In terms of choosing interview dates, I am not sure how Germany works, but I chose my interview/medical date in Vancouver ... but every place is different so you might want to ask about that in the regional forums.
