14 months later and still waiting...it is disheartening to see case completed for some waiting 6-7 months and our case seem to be in stuck mode. On the positive side, come August 10th will be TWO years and since it is obvious my interview will not be before that at least that means the IR1 instead of CR1.

At this point, we have had to respond to false checklists/issues that held up our case for two months and it has been six weeks since addressing all of the NVC requirements. Calling the NVC has only resulted in we have to wait as they are backlogged. Why on earth will they not process in order of acceptance or NOA1 date. I cannot believe what was explained as a 9mth process has mushroomed into a 14 month process. Hugs for all those on the long wait list with us since early 2013.

14 MONTHS!!?? :wow: That's heart breaking! :crying:

However, you may get a CC very soon since you sent your IV package at the end of May! Fingers crossed! :star:

I feel your pain as I approach 13 months. My poor famly in the US has been waiting so long for us to come home. And my poor family in Australia that know we are leaving, but don't know when so it is sort of a sadness that drags along day by day.

Being torn between 2 countries can be so difficult.

Hi Islandbabes,

I feel your frustration. In 2 weeks we will be 15 months from our NOA 1.

It is hard seeing others get through at a faster pace, but harder yet hearing them complain about it.

Anyway, let's hope we all get through soon.

Being torn between 2 countries can be so difficult.

The only good thing is I visited the USA on Christmas Day and then spent 5 months but came back before my 6 months were up. In the interim we established a place but it was heartbreaking to leave. What about those who cannot visit during the time? While we wait at least he comes for our anniversary next month....so over this process.

You are quite correct the living without a date for the future affects your planning and your psyche too .

Am I reading your signature correctly? Your I-130 was approved the same day that USCIS received it? I mean... even if you were expedited... that's just crazy! If so, congrats, you may be the luckiest person in the world.

Scan the NOA2 and send to NVC like they suggested. Then call USCIS to confirm shipping date, ask for Tier 2 rep. I've seen some people who have had their case misplaced or sent back to USCIS in error, so definitely track that down if you've been waiting a while.

That's so terrible. Praying for you guys.

The wiki has a flowchart that shows the order in which the documents follow. I think you have some of them confused.

For AOS: Pay AOS fee, send AOS Docs, wait for review for 30-45 days.

For IV: Fill out DS-261, wait for "review" for 30-45 days, receive/pay IV invoice as soon as DS-261 is accepted, send IV docs and around this same time you will be able to access the DS-260 and fill that out, wait for review for 30-45 days.

You can receive a checklist somewhere in the mix too, and that adds 30-45 days of waiting but may be concurrent with the waiting you are already doing for some other part of the process. Hope that helps!

That's normal. Just keep re-dialing until you get through. Best time to call is when they first open in the morning.

They are inputting data for your case, most likely the IV invoice. This message is normal, although it looks scary, it's actually good news! Check out Saylin's wiki from the first post!

If you have a lawyer, you do not need to fill out the DS-261, and therefore, you will receive the AOS fee and the IV fee at the same time. I would say that is the case for the majority of the cases you are seeing on the spreadsheet where they have sent the packets at the same time. However, there are a few people who got tired of waiting for the IV invoice and just went ahead and sent the IV packet before they paid the fee. Not sure if we've heard yet how that went for them, but I personally think it's risky since you're sending original documents that can be hard to replace. Don't wait to send the AOS with the IV... majority of checklists are received for the AOS, so it's good to send that one asap, just in case you do get a checklist, so you can respond to the checklist asap as well. Hope that helps!!

Oh sorry... I just noticed now, it should be 03/05... Not 02/05.... Thanks..

So, do I understand correctly that I would not need a joint sponsor if I can use assets? What would I need to supply as proof of the value of equity in my house? Would a written valuation and copies of what is outstanding on our home loan be good enough? Also, if I wanted to use money in our bank accounts, is a printout of our balance from our banking website sufficient?

Hi Amanda,

If you already received your AOS checklist and were not checklisted for anything regarding your current employment, -- common sense says to leave it alone. I cannot find any information on the NVC website that points to the petitioner's on going or projected income. Anyone of us (USC), who are petitioning for our spouses, could have unforseen job termination at any point.

On the I-864 form it lists what can be accepted as assets.

Regarding your house, I would get a council rates statement, your home loan statement and a town valuation (which is probably the same as your council rates statement. But obviously anything that shows the value of your asset.

And yes, a bank statement is sufficient as proof to supplement your income/assets.

But, were you checklisted for any of the above?

Thank you for your reply, I feel better knowing that you are thinking along the same lines as me. I just cannot find anywhere that says employment must be ongoing to be a sponsor. All questions ask about current or past income only.

I was not check listed for these things, which is why I am so surprised that people are telling me I will need a joint sponsor. I guess I was assuming if they have already reviewed my AOS and check listed me for something else they would have included this.

In the meantime, I am gathering all of my evidence of assets (I have enough equity in the value of our house) and getting my sister to fill out an AOS to be a joint sponsor to have just in case I get asked for more information at interview. My worst fear would be getting a 2nd checklist and be stuck at NVC for 30 more business days.

Hello all my VJ friends

Back from our wonderful holiday on Hamilton Island It was great to see Andy with the kids again. Shows me just how much we have all missed each other.

Anyway, at Sydney airport at moment waiting to board flight to Adelaide.

Good to see all the case completes but am so frustrated for many of you that you haven't come as far as I thought you would.

Getting your assets together is a good plan.

And having your sister fill out the AOS is a good back up plan.

But, you were not checklisted for anything to do with your employment. And it is your husband that will have the interview, not you, --- meaning you shouldn't be asked about your employment again.

So far, I have not seen a sponsor checklisted twice on the AOS. They've already reviewed it and told you what the problem is.

Provided your current checklist is accepted, you should be good to go.

You'll know soon enough.
