Question on IV doc packet for step child. Please help.

What are the documents I need for IV step daughter? Based on the document list, I have passport, birth certificate and photos. That is it. However how do NVC knows how the petitioner is related to the step daughter. Do I need to provide marriage certificate of the parent with the petitioner and also the marriage termination document of the parent? Or do I have to just mention about the related parent's case who married to the petitioner?

With regard to the custody papers, the instruction only says about custody of the adoptive child, not the step child and so I am thinking the custody paper is not required.

I'm so confused!! I have 3 children-one from a previous relationship and 2 with my husband. We have 2 petitions at NVC CR1 and IR2. We are filling out the i-864 and the household size is confusing the hell out of me. I've been told by NVC not to add my USC children to the household size because they have not been claimed on my husbands taxes. Nobody has been claimed on his taxes, not even me. My USC children have no SSN and my son from previous relationship and I are Canadian citizens. NVC says the i-864 must reflect the tax return. So therefore the i-864's must look like the following

IR1 i -864

Intending immigrant 1

Spouse blank

Self 1

Dependents blank

Total 2

IR2 i-864

Intending immigrant 1

Spouse blank

Self 1

Dependents blank

Total 2.

We all reside together in the same house in Canada with the petitioner.

Can someone please tell me if this is right?

I have asked this question before and got mixed answers. Should i trust NVC? I mean they are the ones completing this cases to the liking of the of the CO's right?? Saylin maybe you could help me? Someone anyone. I am at the point where I want to send 2 i-864 packages for each applicant. One reflecting the taxes and one including my children. Ugh!

I really appreciate the help! Thanks a bunch, stackeria. I've actually found a joint sponsor now with sufficient income, so I don't have to worry about meeting sponsorship requirements. I just want to make sure I'm filling out the correct information in my I-864 form.

Are there any others here that are in the same situation as I am? I've been living and working for the last three years in a foreign country. Since my income is not US sourced I cannot use it to help meet my spouse's sponsorship requirements. If you are could you please share how you filled your I-864 Part 6 lines 5 and 13.a/b/c out? Thanks!

I agree with stackeria. for part 13.abc it depends on how you filed taxes in the USA.

I have been living and working abroad this year so I am putting 0.00 in part 6 Q5 bc its not continuing when I return to US.

for part 13abc I was earning US income so I will put my total amount from my tax transcripts.

No problem! in this case Yes, you can use her current expected income and put it in Part 6 question 5 and provide proof. I suggest reading page 5 of 13 in the I-864 instructions under part 6 item 5. It has examples of what proof is accepted. With this proof I dont think it matters so much as what her past income was just that now she can support you. Someone correct me if im wrong!

I have read on this forum before about calculating your expected income, but Im not 100% sure how to do it so maybe someone else can help if you have further questions about that.

i m from Afghanistan and my interview will be at islamabad embassy pakistan.

i have a passport which is not computerized.. so now the government started the computerized passports. so my case is about to complete in two weeks.. if i change my passport to the new computerized passport.. does it affect my case or should i inform the NVC or islamabad embassy when they get the case? plz

I would get the new passport asap and bring both to the interview. Don't tell NVC anything unless it is your intent to let the process drag (you gave me that impression on more than one occasion). Their role is artificial and a total waste of time. It might be a good idea to email a copy of the new passport to the embassy after they receive your case. Just be sure to mention your case # in that email.

Man, I wish I could help everybody with the tough AOS questions today. Ours was so straightforward, we didn't have any of these children or foreign income issues. I'll try to do some research to see if I can help some of you. I've seen a lot of people these days creating their own threads for their very specific questions and receiving some quality answers. If you haven't already, you could try that.... put as much detail as possible, who is the petitioner, who is the beneficiary, countries that everybody lives in, etc.

I second what MoBar said. Get the new passport. Don't bother with NVC, they likely don't care at this point. Email the embassy when they receive your case, bring both passports to the interview. You're getting closer shinwary, hang in there!

I think we all feel your pain but if you take a look at some other people's timelines on VisaJourney, you'll see that some people have been waiting since January 2013. So, when you put it into perspective, you don't have it that bad. :)

We applied in November thinking this process would take less then a year but it is not looking likely. I asked the last NVC guy when we would likely get an interview if we are approved and he said probably November. This is putting our lives on hold!

WHAT!? There are people who have been waiting since January, 2013!? :wow: THAT IS A CRIME! :protest:

I just did the math to find out how long it'll take for me to finish this immigration process. :idea: FYI, I just paid the IV fee, and NVC is taking up to 5 business days to scan; then, 30 business (45 non-business) days to review a document. :yes: Well, there is a good chance that I'll end up "celebrating" my immi-versary by the time I get the visa. :dead: If I get a checklist, I may not be able to move to the US until next year. :bonk: Yes, needless to say that the US immigration system is totally broken if they can't process a spouse of a US citizen within a year. :no:

Fingers crossed that NVC picks up speed (since I always like to end my posting with a positive note)! :thumbs:

Hello!

Im filling out my I-864 this weekend and I think im done just had a few last questions to make sure im doing it correctly.

- I am proving support with assets as i do not meet the income requirement working abroad. My husband/indenting immigrant will also contribute his assets so we are well above the required amount. In the instructions it says, "page 7 of 13 part 7 6.-8 The form I-864a is not required to document the indenting immigrant's assets." When I called and spoke with NVC I was told to fill out the I-864 and to have my husband fill out the I-864a(he was a bit short with me so I didnt question him). Does anyone know if they require the I-864a even though it says its not required? I know the NVC is tricky sometimes so I just wanted to check with the world of the experienced here :star:

For Part 4 question 5 Country of Domicile - Not sure if I can put both Chile/USA, I reside in Chile but will provide documents of my US mailing address and how I have maintained life in the US with the cover letter suggested in the wikki. (i do not own property in US) Any advice of what to put?

Part 6 Sponsor income and employment - Im employed abroad so I put it, but I want to make sure they are not asking just for USA employment.

For the first part, I don't think you need to send in I-864a with your husband's assets. Just fill in Part 7. numbers 6-8 "Assets of the principal sponsored immigrant" and include documentation. If you were to complete the I-864a for him, you would have to include those figures on 5.a. and 5.b., thus adding those figures twice, so that can't be right.

Domicile: I don't have personal experience with this, but from what I have gathered from the I-864 instructions, I do not think you can put 2 countries as domicile. I would re-read the I-864 instructions pages 3-4 and then hope that someone here with more experience comes along to answer that.

I'm not going to touch Part 6. because I have no idea, and it's too important for me to just take a whack at it!!

Yes, it is somewhat broken and disorganised. I've not looked into it much, but I think the UK has to grant/deny their spouse visa within six months. That was exactly how long it took to get our NOA2 approved and for some they're waiting a lot longer x_x I really wanted to get out to America before Christmas because I wanted to spend my 25th birthday with my husband, but I am thinking I'll need to lower my expectations a bit. I haven't seen him since August last year...

Link to the evidence I submitted. Be sure to send evidence spanning your entire marriage (especially for K-1) or as far back as you can. Just one or two bank statements will not cut it. I primarily focused on the two years of living here since I came in on a CR-1. If you don't have the fundamentals (i.e. joint accounts/policies), you can explain why in the covering letter. E.g. "While we do not have joint utilities, we both contribute to them from our joint bank account".

November 3rd 2016: Biometrics received with appointment date of 11/14/16.

March 14th 2018: Submitted service request due to being outside of processing time.

April 6th 2018: Card in hand. Has incorrect "resident since" date. Submitted service request on I-751 case (typographical error on permanent resident card) and an I-90 online.

April 2018 - August 7th 2018: Tons of service requests, emails and now senator involvement to get my corrected green card back because what the heck, USCIS. Also some time in May I sent a letter to Potomac telling them I want to withdraw my I-90 since CSC were handling it.

August 8th 2018: Card in production thanks to the direct involvement of Senator Sherrod Brown's team

August 13th 2018: Card mailed

August 15th 2018: Card in hand with correct date. :joy:

October 31st 2018: Potomac sends out a notice stating they have closed out my I-90 per my request. Yay for no duplicate card drama.

CIC (Citizenship and Immigration Canada) processes spousal applications in 4-9 months. They often waive an immigration interview if you supply enough supporting documents demonstrating your bona fide relationship. :thumbs:

You want to move to the US to celebrate your 25th B-Day? I thought you wanted to be the world record holder of the longest wait to pay the IV invoice fee? Are you sure you don't want to wait until your 40th B-Day? Just kidding! :rofl:

You haven't seen your hubby since August? Does he have a passport? If so, he can visit the UK unless he is terrified of flying. I'm terrified of flying, by the way. :content: I think you can visit him in the US as long as you have a round-trip ticket and documents that you're returning to the UK. However, I'm not responsible if something goes bad and you end up getting detained! :dead:

CIC (Citizenship and Immigration Canada) processes spousal applications in 4-9 months. They often waive an immigration interview if you supply enough supporting documents demonstrating your bona fide relationship. :thumbs:

You want to move to the US to celebrate your 25th B-Day? I thought you wanted to be the world record holder of the longest wait to pay the IV invoice fee? Are you sure you don't want to wait until your 40th B-Day? Just kidding! :rofl:

You haven't seen your hubby since August? Does he have a passport? If so, he can visit the UK unless he is terrified of flying. I'm terrified of flying, by the way. :content: I think you can visit him in the US as long as you have a round-trip ticket and documents that you're returning to the UK. However, I'm not responsible if something goes bad and you end up getting detained! :dead:

No fear of flying for either of us, but I do have a fear of being detained at the POE which is why I haven't visited since the wedding :P It's an unlikely scenario, I know, but still.

Charlie only gets 5 days off a year and he's used them all! Tbh, I'm not so bothered about the time apart as I am the fact that I can't pinpoint an estimate as to when this will all be over. Whenever I think things are moving along, they screech to a grinding halt again! I'm sure as soon as we DO get the IV invoice, we will be waiting a hella long time for our case to be completed.

I'd still be honoured to be the record-holder, but in all seriousness, if we can't get anyone to unlock it by the end of next week we'll be contacting Charlie's congresswoman to light a fire under their butts.

ROC from CR-1 visa (Green Card expiration date was Nov 24th 2016)

 

Link to the evidence I submitted. Be sure to send evidence spanning your entire marriage (especially for K-1) or as far back as you can. Just one or two bank statements will not cut it. I primarily focused on the two years of living here since I came in on a CR-1. If you don't have the fundamentals (i.e. joint accounts/policies), you can explain why in the covering letter. E.g. "While we do not have joint utilities, we both contribute to them from our joint bank account".

 

September 26th 2016: I-751 package sent to CSC

September 28th 2016: Package delivered
September 30th 2016: Check cashed
October 3rd 2016: NOA1 received with receipt date of 09/28/16
November 3rd 2016: Biometrics received with appointment date of 11/14/16.
November 14th 2016: Attended biometrics appointment
October 30th 2017: Infopass appointment to get I-551 stamp
February 26th 2018: I-751 case number (aka the NOA1 receipt number) becomes trackable
March 14th 2018: Submitted service request due to being outside of processing time.

March 15th 2018: ROC approved. 535 days (1 year, 5 months and 17 days)

March 29th 2018: Card being produced

April 4th 2018: Card mailed out

April 6th 2018: Card in hand. Has incorrect "resident since" date. Submitted service request on I-751 case (typographical error on permanent resident card) and an I-90 online.

April 2018 - August 7th 2018: Tons of service requests, emails and now senator involvement to get my corrected green card back because what the heck, USCIS. Also some time in May I sent a letter to Potomac telling them I want to withdraw my I-90 since CSC were handling it.

August 8th 2018: Card in production thanks to the direct involvement of Senator Sherrod Brown's team

August 13th 2018: Card mailed

August 15th 2018: Card in hand with correct date. :joy:

October 31st 2018: Potomac sends out a notice stating they have closed out my I-90 per my request. Yay for no duplicate card drama.

Hi all,

I was wondering something. I mailed in the corrected I-864 on July 9th which was the same day I received the check list email from NVC. Do you I'll be through all this in time to be with family in the US for Thanksgiving in November?
