Can you work remotely on K1

Hi,

Can K1 visa holder continue to work for home country company while waiting for EAD in US. I have seen few posts saying you can since salary is paid in foreign account while other posts say you can not. If people continue to work for home country company, I guess they must specify that as current employment in G-325A form for AOS.

Has anyone faced it?

what do you mean? how would you work for your home country? do you mean working for your home country but you are presently US ?

Meh- I was against it as you can see in this thread below. Now Im undecided. LOL> (personally my strong feelings were from not wanting a certain K1 I knew at the time doing it and them feeling as if they could)

The bottom line is congress never defined "employment" under the immigration laws, and the definitions of the term in immigration regulations, case law and non-binding policy guidance are incomplete or imprecise.

So arguments are made both ways. Like I said currently I am undecided because of such. To my knowledge (which is limited) no ones been in trouble for it. ..yet.

I would suggest reading the thread and the links in it and then deciding for yourself if you need the income/if the job is going to continue after EAD or not/ and any other circumstances to you personally.
