Petition I-130 approved in under 4 weeks! Next steps..

Hi everyone!

Our petition I-130 has been approved and we only sent it off at the end of May :-D

So now we have the next steps and want to ask a bit of advice please.

1) we don't want to move until January 2015. Hubby wants to have Christmas and New Years with his family in Australia and then we will head to USA. Should we get the second part started straight away? (I'm guessing as the NVC may take a couple of months we should keep acting as soon as possible and make sure everything continues to move smoothly?)

2) we are hoping to use our own assets and I be the sole sponsor showing an intent to be domiciled in USA with him. Our plan is to sell our main house here in Australia while keeping our investment property. We should have well over the $60k on the bank once it sells. Does the cash need to be there for the AOS or would they accept the valuation on the house and proof we are selling it?

Answers:

  1. If you don't want to have the process complete until January, then you can stretch things out at the NVC. They keep cases active for one year from the date of the last action. If you want to the interview to take place in January, then you will want a case complete around the end of November to enter the January scheduling cycle which will take place in December. You may want to start submitting your documents around mid-end October.
  2. The valuation on the house will only be accepted in the form of an official appraisal done by a professional appraiser.

December 18, 2023:  Filed I-90 to renew Green Card

December 21, 2023:  Production of new Green Card ordered - will be seeing USCIS again every 10 years for renewal

You can get the process done now. NVC sometimes take up to three months to complete case. And your husband will be issued a 6months visa after interview which will still be useful in January. Better you get everything done. And get over with it.
