Bank Statement?

Hello so I received the NOA2 in the mail today.

So far my fiance' has the copy of the i129f packet. I just need to make her copies of the RFE I had to send in and the paperwork in the response.

I also have the fiance letter of continued support.

For the I134 and other paperworks I have my LES's since December. I have my 2012 and 2013 W2's. I have my 2012 and 2013 1040s. I have annual statements of TSP (retirement) for 2012 and 2013 and for the first quarter of this year 2014. I have a proof of service letter. I will be getting a letter with my employer soon.

So my main question is since I am the Military and I do make the 100% cutoff. Do I need to provide Bank officer statement of opening the account, past 12 month deposits and current balance?

If not, then should I answer the part on question number 7 on the i134 where it ask my deposit in my savings bank account? I do not want to get RFE if I write something in that blank but do not provide the bank letter. (I do make over 100%)

Also I will already add that I will be making a copy of the NOA2 also and she will provide the information since the petition was filed about our ongoing relationship.

I exceed the limit several times over but get the bank letters, it's effortless. I called up customer service at both my banks (USAA and Chase) who happily mailed them. At the interview I was asked for last years taxes, W2, and bank letters.

so what will happen if they ask for the bank statement or bank letter on the day of the interview and you dont have it on hand? are they going to reschedule you for another interview date or autmatically denied? But everything else is on hand like I-134, letter of employment,pay stabs,1040 W2 income tax return 2011,2012,2013.

That's up to the individual consulate and the person responsible for your case.

It depends on the embassy, what embassy are you processing through?

The I-134 is a generic form, the requirements and instructions stated on it do not necessarily relate to what the embassy requires.

For Manila... NO you do not need bank statements or any asset information, USEM requires your most recent tax return and W-2.

I would suggest reading the embassy instructions letter for the country you are processing through as it will list what the embassy requires for "Evidence of Support"

Here is an example:

This letter is to inform you that the below referenced customer has the following account relationships

with ____ Bank.

If you have questions, please contact me at the number listed below.

Customer name ACCT# Date opened Current balance Annual deposits

Signed by branch manager.....

The annual deposit is just one number totaling all deposits, not each deposit listed separately.

Take the I-134 instructions and circle the paragraph referencing the bank letter with you

and that is all there is to it. You can get it over the phone also and send to you.

I went to my branch in person to make sure it was done correctly with me supervising while she typed.

Nothing to it, easy peasy, just get it, why take the chance on not having it if they ask for it !

And yes, from the past year, so June 2013 to June 2014 and not 2013 only.

Do you have sufficient income to meet the support guidelines? If so then assets do not matter. My income is several times the minimum, and my ITR+W2 are all they needed to see. Never asked for bank statements.

If you meet the income requirements, then no assets need to be used or listed. Leave the entire sections asking about assets blank. No letter from bank or bank statements are needed.

Under general instructions on form I-134 I see nothing written about "if income requirements are met then the bank letter is not needed."

For my personal info please provide a link where it says that on the form.

Has the old I-134 been replaced with a newer one where instructions may have changed ?

You won't find that in the I-134 instructions. Those instructions are pretty vague. Many consulates do not stick to those. Assets are never a requirement though. They are just something that can be used, if needed, to make up for a shortcoming in income. If you do not have assets, or do not want to use assets for an affidavit of support, then you just leave them blank.

I have not seen anyone posting that a CO insisted they have a signed letter from the bank. As long as you prove your income meets the requirement and the foreign fiance(e) will not become a public charge, you will be okay.

For the self-employed, showing bank statements or the letter from the bank could be helpful to show the income that is being deposited. For those that are employees, most recent taxes plus a letter from employer and/or recent pay stubs are all that is needed, if you meet the income requirement.

Edit> Just to add that the I-134 is not even a requirement for consulates. The consulates may(and usually do) ask for an I-134, but it is not required for a K-1 to be issued. Many consulates list what they want included for the financial support, so people should just follow what theirs asks for. If their consulate instructions do not state exactly what to submit, then if an employee and you meet the income requirement, providing the I-134, most recent tax, letter from employer and/or recent pay stubs will most likely be sufficient.

Thanks for explaining, I feel better having the bank letter just because it's on the form instructions even though it may not be needed,

being self employed I definitely will use it.

The instructions do not mention bank statements by the way to those who said bank statements aren't needed I don't use them either.
