Hello, I am reading the following (see below) regarding translations: All documents not written in English, or in the official language of the country in which application for a visa is being made, must be accompanied by certified translations and submitted to the NVC.
Documents the Applicant Must Submit to the NVC
Original Document Requirements

You and each family member immigrating with you to the United States must submit to the NVC original civil documents issued by an appropriate authority, or certified copies of those documents listed in this section.

Photocopy Requirements

You and each family member immigrating with you must also submit to the NVC a photocopy of the original documents or certified copies of the documents.

Translation Requirements

All documents not written in English, or in the official language of the country in which application for a visa is being made, must be accompanied by certified translations and submitted to the NVC. The translation must include a statement signed by the translator stating that the:

  • Translation is accurate, and
  • Translator is competent to translate.
Required Documents

Original documents, photocopies, and translations (if required, as explained above) of the following documents must be submitted to the NVC for you and each family member immigrating with you to the United States.

does this mean that, for applicants from abroad we DO NOT need translations but just the originals.

My example: we live in France with my spouse and kid. The country in which application for a visa is being made is therefore France, and I have all the documents in French.

Dis anyone tried this ?

My guess is that it probably concerns the DCF. But we never know.

On the PRS (Paris) PDF, it is stipulated :

All documents must be in English or French. Documents in all other languages must be

accompanied by certified English-language translations. The translation must include a
signed statement by the translator affirming that the translation is accurate and the translator
is competent to translate.

Does this mean that for Paris there is a kind of "french based" system ?

strange is also the following, stating that POSTAL MAIL SHOUD BE USED for Paris

did you send your application for a visa to USCIS in USA? If yes, then you would need to translate all the documents in English.

Sorry,

just noticed that you've had applied at the consulate. I have no knowledge on how this works in France, but I know someone from Romania who went through the same process like you about 2 years ago and they've submitted the documents in Romanian.

December 21, 2023:  Production of new Green Card ordered - will be seeing USCIS again every 10 years for renewal

The OP's case is beyond the USCIS where translation is necessary. The OP is asking about the NVC documents which is the second stage of the spousal visa process.

Nobody ever sends ANY "visa application" to USCIS, in the USA or anywhere else. Petitions are sent to USCIS. When those petitions are approved, "visa applications" are SENT to NVC in New Hampshire, which is part of the Dept. of State. Exception would be the few countries and situations where petitions can be filed at a US Consulate or Embassy abroad.

Please do not use the term "visa application" or "application" to refer to a PETITION. It causes more confusion here than you can imagine.

The OP has read and understood the instructions correctly. No French documents need to be translated at this stage, the VISA APPLICATION stage. Any French documents submitted to USCIS with the PETITION would require accompanying certified translations to English.

Regarding your addendum. No, the OP did not "apply at the consulate". They filed their petition to the lock box in Chicago, and it was adjudicated at the California Service Center.

Filing a petition is NOT applying for a visa.

NVC, in NEW HAMPSHIRE facilitates the process of applying for a visa at a Consulate abroad. They are not involved when petitions are filed abroad directly at Consulates.

Thanks for clearing everything. Everything you said is perfectly true = I am at NVC stage, therefore applying for the VISA (not USCIS /petition from my spouse).

We filed from France and sent the documents to the USA (= NOT DCF)

If I read correctly your answer:

Thus, it is my understanding that i DO NOT need to send official translations to the NVC (only French official documents)

Please can you RE-confirm that it is the correct process ? I don't want to risk losing 3 weeks of snail-mail just to save a couple hundred euros of translation (for documents that will be -ironically- sent by the NVC to the Embassy in France)

Hi;

 

We are ready to send out IV to NVC. My husband will interview in Budapest (Hungary). Question: our mariage certificat is in English and his police certificate is in Hungarian. Now, do i need Hungarian translation for our marriage certiifcate and English translation for his police certificate? I'm confused. Thank you in advance for an answer!

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).
