K1 Preparing to file - A few questions

Hi everyone!

I've been browsing this site, and it is a great fountain of information. I am preparing to file the paperwork for a K1 visa for my fiancee and I'm just trying to gather as much information as I can to make sure I get everything right. I have a couple of questions that are specific to my case and I haven't been able to get specific information on.

My fiance is a Romanian citizen, but he is living and working(legally) in Hungary. Once the K1 application is processed here, will the packet be sent to the American Consulate in Budapest, Hungary(where he currently resides legally) or to Romania (the country of his nationality)?

There is an age difference between the two of us, (I am older, he is younger) can this be a reason for denial of visa? We have all the necessary proof of a valid relationship (i.e. statement that we intend to marry w/in the stated 90 days, we have met in person during the past two years and have proof of that, etc.) I just wonder if they can legally deny a K1 visa because of an age difference?

Does anyone have an updated timeline for K1 visa (from application to visa in hand) processing and approval with Hungary with me filing the application with the California Service Center? I've been looking on the timelines, but I don't see any information that is recent. From what I see it takes about 6 months, am I wrong in this?

Any information/replies would be greatly appreciated.

There is no way they would do that, you shouldn't worry about it with all the necessary proof you have.

I've been looking on the timelines, but I don't see any information that is recent. From what I see it takes about 6 months, am I wrong in this? I only see 3 cases recorded for Hungary, but I think you should just filter by Service Center, the nationalities shouldn't be the factor for getting approved. currently you should expect 2-3 month through CSC

Any information/replies would be greatly appreciated.

They can deny a visa for any darn reason they want.

I've never heard of someone being denied BECAUSE of an age difference solely. What I have heard of is that an age difference contributing to the consulate questing the legitimacy of the relationship.

How large is the age gap? Is this normal for both of your culture/societies? How do your respective families feel about it? How do you feel about it? Do you have things in common?

The age difference is 8 years (I'm 30, he's 22). We're not concerned about the difference in our ages, neither and it is a non-issue with family and friends. We're both ethnically Hungarian, and there is greater no social stigma for age differences in a relationship in that culture than there is here in the US for example. (Though it seems to be common for the age difference to be the other way, with the man being older and the woman being younger.) Thanks for the explanation on this issue.

I have thought of another question. If the Texas Service Center is no longer handing I-129F applications, why are we still instructed on the forms to mail the application there? Or do I just get the address for the California Service center and mail the application there?

Follow the instructions and mail the package to the Texas center!!! There have been cases earlier this year of packages being returned that were sent directly to CSC.

Age difference in its self is not a reason for denial. However depending on the embassy it could raise questions as to the validity of your relationship.

Remember, the package you are submitting now only requires you to prove that you have met in person within the last 2 years, that you are both eligible to be married, and that you intend to marry within 90 days of your fiancees arrival in the US.

The questions about age might come at your interview, my fiancee is 13 years my junior and the interviewer at the embassy never blinked an eye. As long as you have good proof of valid on going relationship you shouldnt have a problem.

One thing to remember though, it is completely up to the interviewing officer as to whether you have valid relationship or not, denials and approvals vary from embassy to embassy and from interviewer to interviewer.

When my fiancee had her interview, the only questions asked were "How long have you known him?" and has he visited the UK?

My fiancee answered "5 years and yes" that was it. The interviewer didnt even ask to see any of our evidence of ongoing relationship.

However another person i talked to recently was grilled for over a half hour about relationship and required to provide stacks of evidence. The interviewer was the same person and the circumstances with each of our petitions were very much alike. Go figure.

My fiance is 18 years younger than me(He is 22 and I turn 40 in May). I was told it shouldn't be a problem if we have all of the relevant documentation and there are no other red flags, but it would most likely be brought up in the interview and he should definitely be prepared to address the issue. Since your age gap is not as big, maybe it won't even be mentioned, but I would prepere for it to be brought up, anyway.

We're prepared to address the age gap issue if they should ask during the interview at the consulate. Thanks everyone for the replies! I'll be mailing the K-1 visa application to the Texas Service Center as instructed. :)

i have a similiar situation. my fiance is 7 years younger than i am.(i'm the girl)

i'm not sure how to be "prepared" to answer such a question other than say we don't care about the difference! ;) we still have a lot in common so either i'm very immature or he's very mature! haha
