Lawyer who gives wrong info

HHHHMMMMM....

I did alot of research on this website and others in regards to filing a K-1 for my fiance. Then I went to a consulation with a lawyer and a lot of what he and his paralegal said seemed to be inaccurate.

They said

-I need to file the documents at Chigaco, even though I live in PA.

-I need to submit fiance's police record and my avidavit of support with orginal k-1 application, as opposed to submitting it to embassy when its requested.

- My fiance doesn't need a medical exam until he reaches US

and more!!!! I cant believe it. I knew more about this process than they did. I feel like working with such people could jeopardize m case. their errors could delay things. so annoying!

can folks give me advice on going with or without a lawyer?

Aug 2005 -- 1st trip, We meet, become friends; Jan 2006 -- start dating

April 2006 -- 2nd trip, We get engaged; Sept-Nov 2006 -- 3rd trip, More time together

Feb 8, 2007 -- Mailed 129-F package to VSC

Feb 13 -- NOA1!

Feb 19 -- Touched

Feb 20 -- check cashed! NOA1 arrives snail mail!

Feb 22 -- Touched

Mar 8 -- NOA2 email!

Mar 12 -- NVC recieves

Mar 15 -- NVC sends out

Mar. 26 -- Packet 3!

Apr 17 -- Medical

Apr 24 -- Interview, Approved!

Apr 27 -- Picked up passport

May 4 -- POE JFK

May 19-- Apply for SS#

Jul 13 -- Married!

Jul 24 -- Sent out AOS/EAD paperwork

End of Aug -- NOA for EAD and AOS

Sept 6 -- Biometrics

Sep 21 -- Email that AOS app was transfered to CSC

Sept 24 -- Email that EAD is on its way

Oct 10 -- EAD card recvd

Nov 10 -- Email that AOS APPROVED!!!!! (no interview)

Nov 16 -- Green card arrives in mail

Seems rather obvious that you should not with THAT lawyer. You really don't need one if your case is straightforward and you follow the guides here on VJ and on the travel.state.gov site.

The medical does need to be in his country, but the vaccinations can wait until his is in the US if that's what you choose.

p.s. did you tell him he was grossly misinformed and ask him if you were his first K1 consulatation?

Well I think you answered your own question. Just follow the instructions on the I-129 and you will be fine.Also continue to read posts here on this site and I believe you will save yourself not only money but also a possible delays.

May 30, 2007- Packet 3 arrives

May 31, 2007- Faxed Packet 3 stuff back

The only complicated matter in my case is that my fiance has a son who is 2 1/2.

Will that be a problem? Neither he nor I were married before.

Not that I have any experience about this whatsoever, but I think it will be just a little more complicated and worrysome, but still doable. The K1 is for your fiance and the son will get a K2, as far as I know it is all the same paperwork though.

Sad to say this is true for many lawyers. There are good lawyers out there who do this everyday and some very helpful. I alwys suggest finding one that has done many K-1 visas just as you would want from a surgeon doing surgery on yourself. Some lawyers can be very helpful and worth the money if you have some challenges or may be dealing with a certain country. If you think you may have challenges seek a second opinion.

4-10-2007 -Received Package3 via Email

8-07-2007 -Civil Marriage

9-18-2007 -Filed AOS

9-24-2007 -Notice Date

Many people here are doing it themsleves. If it is an easy case, then go for it. There are guides on here to follow and if you have a question and there are many people you have access to for refrences. Read throught the posts. That may help you make a decision. Good luck.

If your case is simple then fly solo. I have learned that lawyers really cant do much for you but fill out your paper work and on top of that you have to say on top of them to follow up on your case. On VJ many people can answer questions through the experiences they have had and their wisdome is a whole lot better than miss inforned lawyers.

About the only thing you have to worry with the child is that you may need the other parent's permission to get the child out of the country. This should not be a problem if your fiance has sole custody. Documentation is the key here.

As for using an attorney, unless your case is very unsual, you are better off doing it yourself. Save the cash to get them here. Just read all forms carefully, follow directions and read the guides VJ has. If you get stuck, just post the question. You will get your answer. I know for a fact that some attorneys out there do not do the work themselves; they have their office staff do it and believe me, sometimes the paperwork is full of mistakes. There are also some good attorneys out there if you do not want to spend the time doing it yourself. The bad attorneys will give you nothing but grief, delay the process and then charge you for it.
