How long does it take NVC to upgrade a petition?

Hi VJ friends ?,

So, i petition for my husband and step-daughter a while ago while I was a LPR. I became a USC shortly after sending my petition and sent to NVC ALL THE DOCUMENTS proving that I was a USC so they could upgrade my category status. My petition was approved, about a month later I got a case number, everything was going beautiful. Well, while I was visiting my hubby in the Dominican Republic, I got an email telling me that there were no visas available at this time! I figured that they never received my USC documents and did not upgrade my category. I sent all the documents again about two weeks ago and I have been calling and they say that they don't have them yet!? Is this normal? I sent them via certified mail so I know that they already received it. Is it possible that my documents are just seating in the mail room still? If anyone had have a similar situation please let me know because this wait is driving me INSANE!

Back then, did you file a separate i130 for your step-daughter?

Yes I did. I filed two separate forms and there were both approved. The thing is that they did not upgrade my category status because (I am just guessing) they didn't receive the copy of my USC certicate. I sent it again, this time via certified mail and I know that they received it but I don't know how long does it actually take to put it in the system.

September 2, 2011: AOS invoice received, OPTIN email for EP sent
September 7, 2011: Paid AOS bill (payment portal showed PAID on September 9, 2011)
September 8, 2011: OPTIN email accepted, GZO number assigned
September 10, 2011: Emailed AOS package
September 12, 2011: IV bill invoiced
September 13, 2011: Paid IV bill (payment portal showed PAID on September 14, 2011)
September 14, 2011: Emailed IV package
October 3, 2011: Emailed checklist response (checklist generated due to typo on Form DS-230)
October 6, 2011: Case complete at NVC
November 10, 2011: Interview - APPROVED!!!

December 18, 2023:  Filed I-90 to renew Green Card

December 21, 2023:  Production of new Green Card ordered - will be seeing USCIS again every 10 years for renewal

My I-130 was approved back in April and after a little bit more than a month, it was received by NVC. When I first filed my petition, I was a Legal Permanent Resident but shortly after I became a USC. I sent a copy of my UC certificate to them way before my I-130 was approved. After the approval, I received an email that said that there were no visas available at this time. I sent the papers again and I have been calling pretty much every single day and they said that they don't have it. I sent via certified mail, so I know for a fact that they received it. How long does it take to physically take the papers and put them in the system? Are my papers just seating there in the mail room? Last time I called they said that if I don't hear from them by the end of the month, I should give them a call. Is this going to really set back my petition process? Please, please,please I beg anybody on this site, familiar with this kind of situations for an answer..

first - find out where it is:

options:

1. scanning area with USCIS [1]

2. loading dock at the Service Center where it was adjudicated [1]

3. NVC MailRoom [2]

4. NRC - National Records Center. [2]

then - you need to talk with USCIS Tier 2/ISO[1] or a supervisor at NVC[2] (yes, both on telephone) - depending on where the casefile is - and tell them -

you are a recent USCitizen and you are worried that your casefile went out to NRC to await a visa number - when instead your Citizenship status was never logged properly. Ask them what to do about logging your USCitizenship status - USCIS ISO's will tell you to email or fax - NVC Supervisors will tell you to EMAIL in a particular way with a particular subject line.

So - you've got some work ahead of you. IF you not get casefile movement INTO NVC within a month's time - start a Congressional Inquiry with the Immigration Liason Staffer in your Congressman's office (you have 3 - 2 senators and 1 representative) .

Darnell I don't think his case is missing from the NVC, simply the papers stating he is a USC.

OP It takes the mailroom at the NVC sometimes a month to get the stuff out. Did you write your case number on the paperwork you sent so they could match it up with your file?

Oh well that's certainly possible. It' would be impossible for the NVC to add paperwork to a case file that is no longer in their possession.

Hi, thank you for replying my question. I got the email during the first week of May while I was visiting my husband. Once I got back to the USA like around the third week of May, I sent the copies of my US certificate, the original letter that I have sent when my case was at uscis stage, and a new letter explaining the whole situation along with NVC case number. I am very worry that they will just lose my papers like they did with the first one ?

Hi, thank you for replying to my inquiry. Yes, I did write everything on the papers I sent. I wrote my name, dob, my husband's name, dob, case number, priority date and two letters. The original one that I sent while the case was at uscis with a copy of I-797 and the new letter explaining how I have already submitted all of these info before.
