Hi, I am from Ghana but I live in Greece. I use to have legal papers with which I live in Greece but right now I do have my papers but my passport only. Can my fiancee who hail from the United States, file a petition for me to join her in the united states; will I be issued a visa to join her despite the fact I do not have legal documents to live in Greece? We have met three times in person and I want to know if she can go ahead and apply for the fiancee visa petition.

Might as well have it done in a country where you have legal residence. Why not have it in Ghana? You will most likely encounter issues come embassy interview time if you pursue to be interviewed in Greece.

Timeline

It is best to return to Ghana and file from there. Having "illegal" residence in a country could definitely cause you to be rejected for US visa.

Just make sure you and your fiancee are on the same page before you go to Ghana.

Sure she can go ahead and file for you now. But you must use your Ghana addresses you will not be able to interview in Greece because you have no legal right to do so. So when the time comes for interview you will have to return to Ghana.

Your illegal status in Greece has no baring on whether the US will grant you a Visa to come or not.
