I-864 help needed (split topic)

Hi everyone;

Very helpful forums so far. My question; My husband and I have an approved I-130, sent already to NVC. I have been calling for the case# (not assigned yet), but I am practicing filling out the AOS (I-864).

Now this is my story; I am currently unemployed and completed with unemployment benefits this past Dec/2013. I was able to file a jointly return with my husband and my son who is 21 years old, as a dependent (household # of 3). I am the petitioner, my husband the Beneficiary. My husband works and pay taxes, but I am still unemployed (and on Medicaid). For the new I-864, Part 6 (item#5), My current individual annual income would be ????? Since I have no current income, I thought maybe I should put Line 22 from 1040 from 2013, is this correct (which is my husband and I income for 2013), or just put 0?

I guessing, we need a sponsor since I have no current job (income 0), and my husband's current income is only 10,000 annually?

We asked his sister who self employed. She filed her taxes with 1099 (added Schedule C, etc.). Nevertheless, her income on the 1040 says 1,942. When we added her 1099 (2 of them) the total comes out to 24,654 (reported on Schedule C). Would she be a good sponsor to add?

July 30, 2011: Received NOA2 hardcopy in mail
August 8, 2011: NVC received file
September 1, 2011: NVC case number assigned
September 2, 2011: AOS invoice received, OPTIN email for EP sent
September 7, 2011: Paid AOS bill (payment portal showed PAID on September 9, 2011)
September 8, 2011: OPTIN email accepted, GZO number assigned
September 10, 2011: Emailed AOS package
September 12, 2011: IV bill invoiced
September 13, 2011: Paid IV bill (payment portal showed PAID on September 14, 2011)
September 14, 2011: Emailed IV package
October 3, 2011: Emailed checklist response (checklist generated due to typo on Form DS-230)
October 6, 2011: Case complete at NVC
November 10, 2011: Interview - APPROVED!!!
December 7, 2011: POE - Sea-Tac Airport

September 17, 2013: Mailed I-751 to CSC

September 23, 2013: Received NOA1 in mail (receipt date September 19th)

October 16, 2013: Biometrics Appointment

January 28, 2014: Production of new Green Card ordered

February 3, 2014: New Green Card received; done with USCIS until fall of 2023*

December 18, 2023:  Filed I-90 to renew Green Card

December 21, 2023:  Production of new Green Card ordered - will be seeing USCIS again every 10 years for renewal

I'm confused. You posted in the CR1/IR1 forum but your profile says you filed for "other". Since the foreign spouse's income only counts if it is going to continue in the USA after moving to the USA, neither of you has ANY current income. You don't make up numbers to look good. When asked for your current income, you answer honestly. Zero, IS a number. Regardless of what kind of case this is, yes, you'll need a qualified joint sponsor.
