Timeline

Took about a week for us after the case number was assigned. You should have your AOS invoices any time now.

Still nothing. I am going to call up tonight.

Both iv and aos.

You can pay them at the same time and you can send the documents at the same time... Just be sure to put the IV docs in one folder and the AOS docs in one folder with their respective cover sheets and them you can put in one UPS/FEDEX/USPS envelope. Also with your I864 be sure to fill out thoroughly because it messes up alot of people. If you are able to use the I864EZ (all criterias at the top must be met), i recommend it because it is much simplier. As always if you have questions let me know.

My husband is the only sponsor. What is the I 864 EZ? I filled out the I 864 form only for him to sign and date and I put N/A in the spaced not applicable. I had print the form from the uscis site.

I thought you could only pay Aos first then had to wait for IV unless you have a lawyer. People are waiting a while for the IV invoice right now after paying Aos and sending tax forms. I'd call nvc and ask about that.

You can pay them when they are available to pay. The website will say "Pay Now"...when you see that you can pay.

Typically both AOS and IV fees become payable at the same time when you use an attorney because you get to skip the DS-261. The completion of the DS-261 takes place before the IV Fee becomes payable. So without an attorney most folks pay the AOS fee and complete the DS-261 once they have their Case Number and IIN. When the AOS shows paid, you submit the AOS Package. Then after the DS-261 is processed the IV Fee becomes payable on the website. So, depending on when the DS-261 is completed, it is possible that you can pay both fees at the same time (for example, you did not pay the AOS Fee right away, but completed the DS-261 quickly).

The thing to keep in mind is that there are two separate processes occurring. The AOS process which is only to pay the AOS Fee and then send the package when it shows paid. And the IV process which is: Complete the DS-261, Pay the IV Fee, and send the IV Package and complete the DS-260 when the IV Fee shows paid. By eliminating the DS-261 with an attorney, both process begin with the payment of each fee.

In other words, folks waiting for the IV fee to be payable are not waiting for the AOS Fee to be paid or the AOD package to be processed. They are waiting on the DS-261 to be processed.

Let me clarify.

Your IV Fee is not selectable to pay in the portal because your DS-261 has not completed processing yet. When I said you can pay both fees together when the say "Pay Now" that assumed they were also available in the portal. Sorry for the confusion. The point I was trying to make was that you can pay the fee as soon as they are selectable and available to pay. You do not have to wait for the AOS payment to be received or have the AOS package processed in order to pay the IV Fee. They are separate chains of processing. The IV Fee is available to pay when the DS-261 processing is completed. That used to be a fast turn around but now I am hearing some reports of 30 days after the 261 is submitted unfortunately.

Called the NVC hotline and the very helpful lady told me that August interviews are out as they just "got" my AOS on 6/30 (even though it arrived a week prior), and it takes 30 working days to get it processed. No idea when IV is available.

If my marriage holds, and I'm now completely unsure where my wife and I are heading, it would seem that September may even be out of reach for the interview.

I hate this process, I really don't want to put a negative light on those people working hard at USCIS and NVC but they don't know their lack of resources is killing my marriage and god knows how many others.

Actually, I think they do. I can't help but think this process is designed to discourage immigration by means of US citizen marriage, which is one of the biggest categories in terms of sheer #'s of visas each year. They either want your marriage to fail or for you to leave the country. Pretty sick and twisted.

There are 3 questions at the top of the i864ez and the answer has to be yes to all 3 in order to use it,

1. I am the petitioner of the family member sponsored on this form

2. I am using only my earned or retirement income which is documented using IRS form W-2

3. The sponsored immigrant is the only person immigrating based on the underlying visa petition

If you have already completed the I864 and had no problems definitely stick with it. However, I864ez is much simplier and has less questions so there is less chance of messing up. I used it for my mom's petition because I wanted to make sure I had no problems.

If they are both available to be paid you can pay both at the same time. They do have to be two separate transactions but can be paid within minutes of each other.
