Timeline

To qualify as head of household you have to meet four conditions (all of them). The most important things are that you are unmarried or considered as unmarried and you have a 'qualifying' child living with you.

So I am not sure if the OP qualifies as HOH without knowing his/her situation. But Married Filing Seperate will work until the 'foreign' spouse is here and has a SS #. Then the tax return can be amended to Married Filing Joint (for a bigger refund, hopefully).

If the foreign spouse is not here and doen't have the SSN then is the status Married Filing Seperate will work?

I just received the call back from the supervisor confirming my case is complete and in line for an interview. I asked a ton of questions about how they assign interviews. She didn't know much but did say its all done electronically. The embassies provide time slots and the types of visas they will interview for . The queue takes them in order. I had a very long conversation about the nasty operators . She told me to send an email and report them because it should not be like that. So here is the email address. We should all report the nasty ones. LOOK OUT JOY and ARTHUR. I suppose we could also send emails of praise too !!

also, she told me again, they are finished with the first round of July interviews. She is not sure if there will be a second round. Sometimes there isn't. I told her that I have heard from others that they are still scheduling for July... her reply was that it is a brand new notification and they probably didn't get it yet. I asked about Costa Rica, she said I am one of very few for Costa Rica so I MIGHT get a July interview but it depends on what Costa Rica provided. She was very nice . She would not say yes or no whether I will be scheduled soon. She explained that they just don't have that information available.

Glad to see the matter settled quickly. It seems this lady went overboard for you and deserves a positive feedback email.

Question, my husband sent me all the documents which are the following: Marriage certificate, birth certificate, police letter, a copy of the passport bio page and he sent me 8 pics 2x2 just in case. I am getting ready to send my IV packet sometime next week. The original documents are in Spanish, he got them translated and everything. So am I also supposed to send the SPANISH version with the English one attached, or just the English one? I am not sending my originals though, I am sending them copies.

You need to send originals.

Just posted the answer to this in my last post. I don't have attorney at NVC stage and they told me I still don't have to fill DS261. They said just nominate yourself by sending them email which I have done already and they also correct record over the phone. I should be fine right? Please let me know if I need to do something because I really really don't want to get checklist.

I'm guessing that because the lawyer was still listed on your case when it arrived at NVC, that's why both fees were automatically invoiced together, hence no DS-261 was needed.

As long as the IV fee is invoiced, then you should have no issues. No need to worry about it.

Correct. And the foreign spouse does not have to sign the tax return. In the box for SSN you put NRA (non-resident alien). Yeah! I know. It sounds scary.

You have to send the originals to NVC unless you have certified copies of the originals. Yes I had the same fear, what if they lose them. But they returned all the originals at the consulate. So I am breathing easy now :)

The same thing happened to me. I think there's some qualification that we have to be financially supporting the spouse to qualify for the exemption. I think that was the reason the IRS dude gave me.

I am guessing when you say "they" you mean IRS. You are correct. Later, when you spouse is here, and got a SS#, you will be submitting an amendment (1040X). This time your filing status will be MFJ. Now you will get a nice refund (sort of wedding gift from the IRS). :) :)

Originals are required. If you don't send them you will receive a checklist and cost yourself a month
