Consulate requested information I don't have (split topic)

My appointment is set for May 29, 2014 in Montreal. I just received an email last Tuesday asking me to bring my husbands 2013 tax that has not been filed. What else can I bring instead? I am scrambling and I sent them 2 emails and called the center and no reply. Your help is truly appreciated.

USCIS

Jan 3 /13 - Priority express mail to USCIS

Jan 4/13 - Received January 4, 2013

Jan 7/13 - NOA1 received

Mar 13/13 - received NOA2 (after 48 business days from NOA1)



NVC

To reach the National Visa Center (Immigrant visa inquiries, including assistance regarding the new DS-260 Online Immigrant Visa Application) call: 603-334-0700 (7:00 am EST to 12:00 pm EST) or e-mail: NVCINQUIRY@state.gov.


Mar 28/13 - NVC received file

Apr 5/13 - case #

Apr 11/13 - DS-261 assigned

Apr 17/13 - DS-261 completed

Apr 17/13 - AOS paid $88

Apr 24/13 - IV paid $240

Apr 29/13 - AOS status PAID, IV PENDING, called regarding barcode said the system is still updating for electronic processing check on Friday.

May 6/13-Paid status

May 10/13 - agent processed

May 24/13 - DS-260 Supporting documents

May24/13- I - 864 Affidavit support


Dec 30/13 - called NVC department informed them of delay of IRS documents. An extension was given by Shelly until December 30/14.

Feb 11/14 - Emailed AOS checklist

Feb 24/14 - Follow up call on AOS checklist - haven't received it yet

Feb 28/14 - Follow up call on AOS checklist - Kelly - haven't received it yet

Mar 06/14 - Received checklist revision - missing information

Mar 06/14 - Sent back AOS checklist with new I-864 form

You either need to bring proof of an extension having been filed or bring his 2013 tax information and an updated I-864.

December 21, 2023:  Production of new Green Card ordered - will be seeing USCIS again every 10 years for renewal

If your husband hasn't filed taxes yet and hasn't filed for an extension, you won't be eligible for the visa.

If he didn't file for an extension before April 15th, he must file his tax return now and hand over the transcript to you when available. If the transcript isn't available on time, his 1040 and W-2 (plus any other things like 1099, 401k... I don't know about these too much) copies must be taken by you to the interview.

Of course, if he did file an extension, he will have some kind of paperwork proving this and that would be what you take instead.

ROC from CR-1 visa (Green Card expiration date was Nov 24th 2016)

 

Link to the evidence I submitted. Be sure to send evidence spanning your entire marriage (especially for K-1) or as far back as you can. Just one or two bank statements will not cut it. I primarily focused on the two years of living here since I came in on a CR-1. If you don't have the fundamentals (i.e. joint accounts/policies), you can explain why in the covering letter. E.g. "While we do not have joint utilities, we both contribute to them from our joint bank account".

 

September 26th 2016: I-751 package sent to CSC

September 28th 2016: Package delivered
September 30th 2016: Check cashed
October 3rd 2016: NOA1 received with receipt date of 09/28/16
November 3rd 2016: Biometrics received with appointment date of 11/14/16.
November 14th 2016: Attended biometrics appointment
October 30th 2017: Infopass appointment to get I-551 stamp
February 26th 2018: I-751 case number (aka the NOA1 receipt number) becomes trackable
March 14th 2018: Submitted service request due to being outside of processing time.

March 15th 2018: ROC approved. 535 days (1 year, 5 months and 17 days)

March 29th 2018: Card being produced

April 4th 2018: Card mailed out

April 6th 2018: Card in hand. Has incorrect "resident since" date. Submitted service request on I-751 case (typographical error on permanent resident card) and an I-90 online.

April 2018 - August 7th 2018: Tons of service requests, emails and now senator involvement to get my corrected green card back because what the heck, USCIS. Also some time in May I sent a letter to Potomac telling them I want to withdraw my I-90 since CSC were handling it.

August 8th 2018: Card in production thanks to the direct involvement of Senator Sherrod Brown's team

August 13th 2018: Card mailed

August 15th 2018: Card in hand with correct date. :joy:

October 31st 2018: Potomac sends out a notice stating they have closed out my I-90 per my request. Yay for no duplicate card drama.

2. if he can file this upcoming week - show up at the local IRS office with 2 SETS of complete tax return documents - give 1 to the IRS clerk and on the 2nd - ask the clerk to STAMP them with the official IRS stamp - then he ships the entire stamped 2nd set to you on light-speed courier.

Sometimes my language usage seems confusing - please feel free to 'read it twice', just in case !

Sure, but since it's a copy that's needed, why not simply scan and email or fax it??? He can also file online, save the return to PDF from Turbo Tax etc. then email the PDF for printing wherever.

If he filed an extension, he has an extension form. If he didn't, he should simply file and email a copy of the return. If he DID file an extension, then he needs to send the W2 and a copy of the extension form.

Facts are cheap...knowing how to use them is precious...

but I prefer to give advice and outline stuff that overcomes any trepidation of ANY VICE-CONSUL during the adjudication process at an IV Unit.

Sometimes my language usage seems confusing - please feel free to 'read it twice', just in case !

And you think physically shipping paper printed upon in the USA will be more convincing to the Consular Officer than something emailed and printed in another country?

FYI, at a US Consulate visa unit of any kind, interviews are conducted by a "Consular Officer", who works for a Consular "Unit Chief" (in our context the Chief of the Immigrant Visa Unit.), who works for the Consul General. Never seen the term "Vice-Consul" used as a title for any employee of the US Dept. of State. Have you?

FYI, at a US Consulate visa unit of any kind, interviews are conducted by a "Consular Officer", who works for a Consular "Unit Chief" (in our context the Chief of the Immigrant Visa Unit.), who works for the Consul General. Never seen the term "Vice-Consul" used as a title for any employee of the US Dept. of State. Have you?

Most of the interviewing officers are Vice Consuls. A Vice Consul is an entry level officer serving in the consular section. "Consular Officer" is a more general term that applies to any officer in the consular section, regardless of their level. And, BTW, depending on the size of the Embassy/Consular Section there may or may not be a Unit Chief or a Consul General. To further add to the confusion, if the consular section is at a Consulate General post, the Consul General is not even in the consular section -- he/she is the principal officer of the Consulate General, responsible for all consulate activities. In that case, the main person in the consular section has a title similar to Chief of Consular Services or Consular Section Chief.

As long as people are clear on who they are talking about, I really don't think there's a big concern about the label someone uses to describe the interviewing officer (aka the visa officer, aka the consular officer, aka all the other labels that people have used to clearly communicate what they mean).
