Can change of status from tourist visa to CR1 take place in USA?

Hello VJ members

I have applied to CR1 since August 2013. Currently NVC has asked for missing documents in AOS support.

I have tourist visa with multiple entries valid for 10 years to USA issued in Jan 2014.

Kindly let me know if it is possible to travel to USA on tourist visa and get the status converted to CR1 there itself? If yes, what is the process like?

08 Aug 2013 - Case accepted at USCIS
22 Feb 2014 - case transferred at NVC (post clearance and acceptance at USCIS)
18 Apr 2014 - Paid AOS fees
29 Apr 2014 - Paid IV fees
05 May 2014 - Filled DS 260 form
03 Jun 2014 - Submitted AOS and IV documents
07 Jun 2014 - Acknowledge by telephone representative of AOS & IV documents received
08 Jul 2014 - Checklist from NVC, mentioning list of docs to be brought at Interview
10 Jul 2014 - Interview date confirmation on call
11 Jul 2014 - Received mail notification of Interview on 19 Aug 2014
13 Jul 2014 - Fingerprinting done at VAC Mumbai
11 Aug 2014 - Medical Exam at Rele Clinic Mumbai
19 Aug 2014 - Interview at Mumbai Consulate

hi

plus the forms are different. the consular processing is different from adjusting status

the ds261 and ds260 are only for consular processing

Actually, the answer is yes. If you are visiting the USA, and while here, decide to adjust your status, you can do that. Follow this guide provided by Visa Journey. http://www.visajourney.com/content/i130guide2

You will want to heed the warning in the guide, and would be wise to consult a qualified Immigration Attorney as to the advisability, under your specific circumstances, as to which immigration path is appropriate for you.

In my experience, intent upon entry is not grounds for denying adjustment of status to the spouse of a US Citizen. Whatever you do, to not tell any lies to the Customs and Border Control agent upon entering the USA.

***Thread closed to additional discussion; while intent to adjust using a tourist visa may not be grounds for a denial of AOS, it is violation of the TOS to advise anyone directly or indirectly to do this.***

December 18, 2023:  Filed I-90 to renew Green Card

December 21, 2023:  Production of new Green Card ordered - will be seeing USCIS again every 10 years for renewal
