K-1 denied, now filing for spouse visa

Hello every one.

after been put on AP from Jan 2014, finally got a denial of my K-1 in April.

Now married and starting the spouse Visa.

Just advices from experiencd VJ members on what we'll need to do to succeed with this.

Dont ask me what happeneed with the k-1 or what did we give as evidences and stuff like that.

In order to succeed with the CR/IR petition you will have to submit most of the same evidence you did for the K-1, so it is fair to presume you will find the same sort of hurdles you did with that process, including AP.

To be successful you have to overcome the red flags or issues you have. Getting married doesn’t always eliminate that.

If you know specifically why you were denied then hopefully you have the evidence to show.

We have no way of helping you without you telling us why denied and maybe there’s someone who went through similar that came give you some assistance.

Sorry for the denial but to help you, you need to help us.

I would like to ask in total how much facetime have you spent together? Seems the CO wasn't too convinced you were to get married? Is there a big age difference (the woman being older)?

I agree with the others in order to help we need to know the red flags. Your timeline doesnt really say much other that you were put on AP and denied about a month after. I am going through AP right now and i know i had two red flags my age difference i am 12 years older than him and my divorce was finalized when we were together. We did provide more than enough evidence of a relationship of almost 2 years and i have visit him 8 times. Let us know the details. That would not only help you but others going through your experience.

You need to provide all the evidence previously provided plus a lot more. Just getting married does not prove you have a real relationship. I would suggest adding photos of the two of you together and with family/neighbors/significant others. Proof of multiple visits would help (I assume there was at least one more meeting since you are married). Affidavits from family/neighbors/friends are helpful but only as secondary evidence. Proof of mingled finances (which I know is difficult when you live in separate countries) such as beneficiary on insurance policies. Notarized copies of your wills leaving things to the spouse upon death. Anything and everything you can come up with to prove the two of you intend to live a long, happy life together as husband and wife.

Well, obviously you will have to do more this petition as far a proof than you did the last one, since they denied you. But not knowing what you submitted before, I certainly cannot tell you what you should add... To get a complete answer, you must provide complete info... If you can't make that effort, neither can we.

I am not searching through any clues about your previous petition like I am on an Easter egg hunt.
If you want answers then put in some effort to specify what needs to be addressed here in order to help you.
It is presumptuous of you to expect anyone to help when you basically want everyone to mind read your situation and say don't ask

questions.
Address your reasons for denial if known. List your circumstances and share them here or figure it out yourself.

At the last meeting with the CO, he said... I don't believe you two will get married when you get to US.

I asked him.... So what do we do now? Cuz we have to be together.

He replied... Why didn't you two marry at once when she came? Well, you can reapply for a K-1 if you can prove your serious. Or better still, she can still come here and marry you.

Now what in your evidence do you think would make them come to that conclusion? Are you an woman significantly order than him? Been married before? Older kids.

What about visits? How many visits to Cameroon? And for how long?

Facetime is the #1 Evidence nothing trumps that not even having children.

I read your interview report. You left out the answers to the most important questions you indicated you were asked.

What IS your age? What is your US Citizen wife's age? How many trips has she made to see you? How long was each trip?

Why do YOU think the Consular Officer did not believe your relationship was genuine?

What exactly did your visa denial paper say was the reason for the denial?

CO suspected the K1 is for immigration benefits only and he was suspicious. I see no factual reason why he should have refused

the visa from what you have described other than his discretionary speculation and assumption.

11 years age difference is not that big of a deal.

You had plenty of communication ad other relationship evidence.

I would have front loaded the petition with more photos showing the petitioner with your family.

He insinuated a first meeting wedding would have been better but that is nuts and a reason for other CO's to not issue the visa.

Damned if you do and damned if you don't scenario.

The petitioner should have been there during the interview.

TIA = This is Africa and many countries in the sub-saharan have difficult consulates. It is what it is. Unfair but reality.

I also communicate with my fiance several times daily and if the CO doesn't with his spouse/family then that is his choice

and it is ignorant to suspect you of being a yahoo boy chatting up for romance without factual evidence but again

here is the CO's discretionary power.

He can think and assume as he pleases.

What you can do now :

Filing a CR1 will overcome the "I don't believe you will marry" BS.

Submit photos with family together.

Have her with you at the interview, if she isn't allowed in then hand over her passport to the CO and say

that she is waiting outside and would love to speak with you.

I am a re filer also, but for another K1. Been there, done that and have the T-shirt.

One thing I noticed missing is copies of the airline tickets from the visit, passport stamps, receipts for things you did together... Computer chat is OK, but FaceTime together is priceless ...
