Fiancée and I live outside US...

Hello!

I'm an American citizen and my fiancée is Canadian. Currently we both live and work in Canada, together by the way so easy to prove we've met lol. However, we are wanting to move to the US and I'm sure the K1 is what we need but I cannot find anything about the US filer living outside the US except for spouses. Is this going to be an issue since we don't have a determined address in the US yet? Also, I won't have a job when we move but we will be well above the income requirement so I'm guessing filling out an affidavit with proof of money would work.

Anyway, does anyone know if we might have issues with the above?

THere is a thing called Direct Consular filing. I don't know much about it or the requirements, but it is for those couples where both the USC and the alien live in the ailen's country. Maybe you should check into this.

Hi,

My fiancee has been living with me in Australia for the last 6 years. We have applied for the K1 and the only difference is that we need prove that she can re establish Domicile. We are going through an attorney because we thought this would be difficult (Apparently its not, awesome waste of money that was!)

From what I understand if you search re establishing Domicile you can get a bunch of info on it. Things like still having your drivers licence, showing that you have been applying for work, etc.

We will be moving in with her family and they will be co sponsoring me due to my partner not having an income in the USA. We have more than enough money in the bank to meet the poverty line but we have been advised from our attorney that we will still need a co sponsor.

From what I know you need to have an address in the USA for the paper work to get sent to. We get everything sent to my partners folks house and they forward it to us.

We got our NOA 2 in 12 days so so far it seems like we are doing ok!

I live with my Fiance in Canada. He works for an American company so his income is in the USA. We did not use a US address when we filed i129f. I used the advice of another member, and in the US address box put "TBD". We used our current address for both of us. We have now received our NOA2 without any apparent problems. Establishing domicile is more to do with having a way to earn income in the US rather than a physical address I think. Hope this helps.
