Applying for K1 visa with a child together

My fiance and I have a 4 year old. We have been in a relationship now for 6 years. I have read a few posts where the couples that have a child or children together have been denied visa's, not necessarily due to having a child, but it's just been coincidence that the one's I've read about have all been denied.

My question is, does us having a four year old together raise red flags? Also, will the length of our relationship pose red flags?

You will likely have a DNA test request to proof it is his child.
In and of itself it is not a red flag to have a child.

Whether it raises a flag about the long relationship depends on the circumstances and reasons behind not filing sooner.
Usually a long relationship is a plus and not a minus if you have solid relationship evidence showing a genuine bona fide

relationship. 6 years is stronger than 6 months. Why have you not filed sooner though ? Have you lived with him in his country ?

Did you already file CRBA for the child? Does the child have a US birth certificate or US passport?

No, we've not filed a CBRA. What is that? Yes, she was born here in the states.

I don't see why your child together will cause a red flag. As long as your relationship is bonafide you'll be fine.

It's a long story, but basically the plan was for me to move to 9ja, but I was working on my MBA when we started dating, so I said I would move there once I finished. Well, I was offered an amazing job with the perfect company that I've always wanted to work so I convinced him that it would be best for him to come here especially since we would have to uproot our daughter as well.

Also, I'm Nigerian as well-my mom is a Niger wife so my parents live in Nigeria as well. So to answer the question about living in his home country, yes I grew up there, but not lived with him.

Sounds like you will have no problems as long as you can back up your circumstances with evidence as Lagos is one of the most

difficult embassies to go through.

If you had anything resembling a traditional ceremony without being registered then it can be mistaken that you are married and your fiance could be found ineligible for the K1.
