Police Record from the...US?

My fiance is from Tonga and here was here in the US on a religious visa for 2 years. He finished his work a year ago and went home (a week after we met) and has been trying to get back ever since. Our I-129F was just approved last night so we are waiting on the NOA2. My question is: do we have to get a police record from the US since he lived here for 2 years? I'm assuming the government has/will do background checks on him regardless, so I am wondering if this is necessary. The process to get a police record from the FBI apparently takes 16-18 weeks :blink:

I don't believe you need it from the US, only from the country he lives in, I personally would get one for the time that he spent here yes, just to be on the safe side, but to just be sure I would call USCIS and ask this question..... and no the request for a full background check takes a max of 2 weeks in total. Also congrats on your approval..... you seem to have gotten it quite fast coming from TSC

From what I can deduce, he would need the police record from the country that he is in and not the US. I believe when you submit your information to USCIS, they will do the background checks, inclu. police records from here in the US. that is why you have to submit so much information on the G325A forms.

OK...I thought that he needs a police record from any country he has spent 6 months or longer in, so I wasn't sure if the US was part of that. he also was in New Zealand for 3 months in 2013, left for Tonga for 3 months and then was back in New Zealand for 3 months this year....does he need a police record from there then?

And yes, we got our NY senator involved last Thursday and approval was here yesterday. Highly recommend it!

I got my US police cert before they sent the packet 3 (because these things take time), and in the packet 3, it clearly states that you do not need a police cert from the US. The consulate officer did not ask me for one either.

Yes - any countries that he has lived in for more than 1 year since turning 16. Except for the US.

I got mixed information. I thought it was more than anywhere for more than 6 months, so I got one for when I lived in Australia for about 10 months. But when I got there, the consular officer (and packet three) states more than 12 months. He didn't request to see my Australia one even though he knew that I lived there for under a year.

edit: just saw the times he was in NZ - I believe he won't need to. It's consecutive stay, and since he was only there for three months at a time, it doesn't count.
