I am the beneficiary. My husband (us citizen) filed a petition for me from outside the us when we decided to move to the US. In the meanwhile, he needed to move to the states quicker than we thought for his work. So, he now we are separated and me and our kids miss him a lot. My i-130 was approved and now i have started the procedure with the NVC and it is going slowly. Very slowly.

Can i use my tourist visa to visit my husband and ask for I-485 after 60 days or is to risky? another question, in case i decide to do that, is the I-130 still valid or should he file the petition all over again?

any other advises?

Thanks

Absolutely not - you can not use your tourist visa to immigrate. That would be immigration fraud.

Sit back and wait your turn like the rest of the people - it won't be much longer until your interview.

Hi,

It is immigration fraud to enter the US on a tourist visa with the intent to immigrate.

It would be extremely foolish to attempt to circumvent the law when you are so close to getting your immigration visa.

Be patience and best of luck to you.

I suggest you visit for a while, as a "visitor", if you feel the need and can afford it. At this point in your process, it really is best to proceed with the immigrant visa. There is never a guarantee of entry, even with the visa though, so do so at your own risk.
