Are foreign fiances receiving a copy of the DHS background check?

According to the International Marriage Broker Act, the foreign fiance of an American petitioner is supposed to receive a copy of the DHS background check on the petitioner as part of the NOA2 approval process.

I'm curious if that is really happening and would love to hear from those already past the interview.

The background check is never disclosed to either the petitioner or the beneficiary. However, if the petitioner has been convicted of a violent crime, especially domestic violence, they must disclose it in the original petition accompanied by copies of certified arrest records and court records. If the case is approved, this information will be provided to the beneficiary who will be given other information that may help her to reconsider.

So they don't always deny an application with a history of domestic violence? I thought that was sort of the point of the whole thing.

You request a waiver if you have a Domestic Violence conviction.

not quite. if the petitioner has not filed for two or more beneficiaries in the past (multiple filer) then no waiver is required.

Flying to Seattle on 6 May 2014!
