Hi,I was filling DS261 form and there was a question have you already legally immigrat to US ? what should I have to fill there Since I am petionar and filling my info in personal info becz I doen't have lawyer?

Hello and welcome, my case was approved from USCIS on April 8Th and received at NVC April 25. Have you called them yet to see if they have received your files yet? If not call NVC at (603)334-0700 from 7am to Midnight Eastern time. Try to call after five you will miss the more grumpy

people that work there like Joy and Arthur if you get them when calling in the morning just hang up. hahaaaa :rofl: I mean your husband should

call I can only imagine how much it would cost from Chile and by the way VIva Chile! I was born in Ecuador.

Oh yeah, I already spoke to a couple of really grumpy ones, but the one that answered me yesterday (Tom) was really nice!

If you put YES you won't be able to go farther, as it means you already immigrated legally in the US and therefore that you don't need a CR-1 or IR-1 visa anymore. Hope this helps

Well, they've had my AOS for 2 weeks not (still hasn't been reviewed) and they got the IV on Friday. I'm thinking and hoping for early June case complete. I forgot to ask the Agent what day they were currently working on, but I don't know if she would have handed that info out willy nilly.

Fill it out from the beneficiary's perspective, as that's who the form is designed for... so if it was your spouse filling it in, what would they say?

So say 'no'

In first page personal info should be beneficiary info and In question do you wish to appoint an agent ,I need to select "yes" then can fill petitioner info .Then agent state city all petitioner info .I am right?

I can tell you that it seems to be random within certain demographics. Three of my wife's nephews applied at the same time for student visas a couple of years ago. All fresh out of high school, All had the same common last name. One had several previous visits to Iran for religious pilgrimages and the other two none. One of them was put on administrative processing for several months and the other two got their visas on the spot. The Iran frequent flyer was not the one put on AP.

In my case, I got a J1 visa in 2007 as a visiting professor and opted to leave the family home and only shuttle back and forth every couple of months. Within that year my wife was diagnosed with cancer, so I applied for a B1/B2 visa for her and the kids as she refused to travel for her treatment without them. For good measure, since I would show up at the interview on my family's behalf (kids underage and wife in hospital), I simultaneously and naively applied for one for myself. My best guess, this is the reason for the AP I got, especially since it ended exactly two years after the issuance of my J1 visa. Their other options would have been to either deny my B1/B2 visa application or cancel my J1 visa. I would have faired much worse with either. So, in a weird way, I'm thankful for that AP. In fact, looking back, I am amazed that they approved my wife's visa without an interview.

By the way, once you're in AP, they never tell you why or for how long. They don't tell you why even after you get the clearance. The only thing you get is the stamped visa with a "Clearance Received mm/dd/yyyy" printed at the bottom to show for it. The above explanation for my AP is just guesswork on my part and I could be totally off the mark.

I'm so sorry about your wife must have been just horrible for you and the children.

When you give anyone person that much power nothing makes sense anymore. In Egypt it seems to be put on AP is the norm and God only knows

how long it will be. I'll be praying for all of us facing this travesty.

That's make sense. if your agent (Friend /relative) or petitioner, you can fill their info... then they will get invoice and further bill payment emails.
