Hey guys,

As I mentioned a few days ago about the major setback in our case. I phoned the NVC two more times and spoke with 2 different supervisors and they stated we had somehow enrolled in EP (without ever sending an enroll email in EP). Our package which was sent to them on Apr 12, they have no idea where it is. They stated it would be sent back to us when the rep looking at that packed pulls up our file because we're EP. Its really discouraging to see what's going on with our file. We approached our lawyers as well and they confirmed they never enroll anyone in EP and they certainly hadn't enrolled us.

Anyway, the question here is the NVC still hasn't returned our package with all the original documents and the papers dated 31/03/2014. However our lawyer has all the photocopies of the papers. Would that be ok to send in to the NVC? I am working on getting our original marriage certificate and birth certificate re-ordered to bring to the interview.

Any insight is appreciated.

You're right! You can't change the past so there is no sense in thinking about it. :no:

I could have applied for a fiance visa and that would have been faster. Well, I thought it would be faster if we got married and applied for a IR1/CR1 visa. :bonk: It's unfortunate, but that's life. :wacko:

Since I've been not so lucky in this process, I'm hoping I've used up all my bad luck so I'll finish the NVC stage without a single checklist. :yes:

unlucky doesn't even to begin to describe my journey.. It took 11 months for the USCIS to approve us... I watched everyone get approve left and right. That was so hard !! Its almost over though !!! If the USCIS only took 7 months, I would be just about home free by now... We still have a waiver to file that is another 6-8 more months of waiting. Sometimes life bites ya in the a$$.. I'm trying to deal with the long wait ahead and it didn't even happen yet.

I'll be on the lookout for a checklist. How do they usually come? In the email or snail mail? The NVC has sent me an automated message at every step so far. Jw.

Checklists can come both via email and via mail. My false, and inaccurate ones have come both by mail and by email.

I-130 for both parents

March 28th 2013 - Priority date/ NOA 1
November 14th 2013 - Transferred to Nebraska Service Center

January 7th 2014 - Case changed online to approved for both

January 8th 2014 - case changed to shipped to NVC

January 9th 2014 - case changed to NOA 2 mailed

January 10th 2014 - Received the hardcopy of the NOA 2 stating that NVC would issue a case number in 30 days approx.

January 21st 2014 - Case Received at NVC

February 26th 2014 - Case numbers and IIN number received - Wrong embassy code assigned...now waiting for new case numbers.

March 3rd 2014 - Filled in DS-261 for both parents

March 5th 2014- AOS available, paid and submitted AOS packet.

I'll jump in the "unlucky" boat with you. After waiting 9 months, I get a BS RFE. I get approved after over 10 months. Then get THREE BS checklists in NVC.

Oh well.

My husband got a letter in the mail from NVC saying the AOS and DS-261 are ready. :rofl:

The DS-261 was done on May 1 and the AOS was paid on the 2nd!!

Hi! I need help figuring out what's the status of our case. (Our lawyers submitted things out of order, and messed up with my understanding of the process).

Anyway, my husband called today and said:

1) "AOS has been assessed and accepted, no date listed but it would have been before the last mailing we got which was April 28." Yeah!

2) "Looks like civil documents arrived April 14, but he can only tell me they received mail that day, not what was in the mail." Our DS260 was submitted on May 1.

So... Looks like our IV packet hasn't been scanned yet. If so, our 20-30 days to case complete or checklist hasn't started ticking yet. Am I reading this correctly? If so, when could we expect the packet to be scanned? How can we estimate when we'll have a case complete/ checklist?

11 months to get approved by USCIS AND 6-8 more months!? :wow:

I thought you were super lucky since you got your case number on the day NVC received your file. I wasn't exactly paying attention to your timeline. :wacko:

Yes, it must have been difficult to watch everyone getting approved left and right. I hear ya. My PD is Oct 4, but I watched other Oct filers getting approved before me. I was like, "What about me? Where is my darn approval email?" :bonk:

While I was happy for other people getting approved, it made me feel anxious and angry at USCIS at the same time. Strange feeling! :unsure:

It's my understanding that not all people filing from abroad have a job lined up for when they come back to the U.S. with their spouse (beneficiary). That's why we have a joint sponsor, showing that we have someone who can financially support my spouse because right now, I don't have any income. I think there are plenty of other ways to prove that I have MAINTAINED a U.S. domicile, besides trying to show that I have a job opportunity available. Yes, of course it would help to show a job offer, but I don't think that it is required.

True. We have saved for the past two years, but we used a joint sponsor. My wife won't probably start applying for jobs until we know when the interview is so we know when we're roughly moving to the states. It's kind of hard in this stage to tell them an estimate of when you'll be able to begin employment.

It's true. I think everyone is this past year with USCIS have been unlucky.. I'm hoping we all have good luck now and we all get on with our lives :).

If they can see that they received mail from you it means it has been scanned into the system.

Usually, it takes 2 to 3 weeks after its scanned for the packet to be reviewed!!!! so, this is very disturbing and I hope they are not backlogged again.

You should've gotten case complete already bu now if everything wasw done correctly!!!!!!!!!!!!

Hey, how did you find out that the police certificate is not required for your country at the NVC stage? Is there a list of countries somewhere?

Just in case you're wondering, a police certificate IS required for Mexico.

When I petitioned my husband in 2012 we were not required to get a Police Certificate. This scared me for a moment thinking that maybe things had changed and they are now required. I double checked country specific reciprocity for Mexico and if you'll scroll down you'll see that they are still unavailable. Phew. I think I just had a stroke.

Timeline

When I petitioned my husband in 2012 we were not required to get a Police Certificate. This scared me for a moment thinking that maybe things had changed and they are now required. I double checked country specific reciprocity for Mexico and if you'll scroll down you'll see that they are still unavailable. Phew. I think I just had a stroke.

We were required to get one, we sent it in, and have case complete. I wouldn't risk a checklist. It's too easy to obtain one.
