Doing K3 in country of marriage

:huh: Hi everyone...

My husband and I married in Denmark and were told by our lawyer and now NVC that we will have to go through the embassy there, even though we live in Germany and are residents here. Has anyone else had the experience of doing the K3 through an embassy in a country where they don't live/are not a resident? It seems soooo weird, especially because we have no other ties to Denamark at all...I almost expect them to refuse our case...

I-130/CR-1

10/7-12/29/05: NOA 1+2

8/10/06: case received in Frankfurt--get letter asking for more info

think we'll adjust in the states...

K3

2/7/06: NOA 2

4/24/06: Interview in Copenhagen

5/17/06: Sent additional info. requested

8/9/06: e-mail from embassy that they are ready to issue visa

8/23/06: visa in hand

It is in fact true. You must have your interview at the Embassy in the country in which you were married. A friend of mine is being interviewed in Vancouver, British Columbia, Canada, she is the USC and he is a UK citizen. They married in Victoria, British Columbia.

May 15/07... 10-Yr. PR Card arrives in the mail

Aug. 21/08... Interview - PASSED!!!!

Sept. 2/08... Oath Ceremony

Sept. 5/08... Sent in Voter Registration Card

Sept. 9/08... SSA office to change status to "U.S. citizen"

Oct. 8/08... Applied in person for U.S. Passport

Oct. 22/08... U.S. Passport received

May 26/05... K-2 Interview - APPROVED!!!!

Feb. 22/06... AOS Interview - APPROVED!!!!! (Passport NOT stamped)

Dec. 4/07... I-751 sent to NSC

May 23/08... 10-Yr. PR Card arrives in the mail

Mar. 22/11.... N-400 sent to AZ

June 27/11..... Interview - PASSED!!!

July 12/11..... Oath Ceremony

Just like what happened to us. We married in another country and we do not have any idea that K3 will be processed in the country of marriage. We were just so glad that our I-130 was approved faster. So we decided not to pursue the I-129F and rather go with the I-130. The I-130 is better so far anyway than I-129F as it is an immigrant visa though it takes a while at the NVC.

June 15, 2009 - Notice Date

June 19, 2009 - Recieved NOA

July 15, 2009 - Scheduled for biometrics

Sept 21, 2009 - Scheduled for Interview ....Passed the interview test

Oct. 16, 2009 - Oath taking

The only time a K-3 is not done in the country of marriage is if the marriage takes place in the US. It is then conducted in the country of residence of the applicant. CR-1's however, as JR stated are conducted in country of residence regardless of where marriage takes place.

Yeah you are lucky the country wasnt too far away. The medical would be a pain though I imagine :unsure: or can it be done in your country of residence?

Or if there is no IV issuing post in the country of marriage, in which case one would have to go to the post that serves that country.

the medical has to be done in Denmark, too. We have to do it 2 weeks before the interview...guess we'llbe travelling a lot!

Yep I am UKC married to USC who has to travel to Vancouver for interview and medical,but thanks to my brilliant wife : (L) who has sorted it all out for me got medical booked a few days before interview and even time for a bit of a vacation,so if you get prepared then its no big deal,we have both found this out preparation is the key to the minimum hassle for this visa thing,so if all goes well should be over in US shortly,although we are thinking I will have to apply for waiver but its all ready to go if we have too, :thumbs::diablo:

I was wondering if anybody has any experiences to share about a k-3 interview, where you were married and interviewed in a country other than your spouses country of residence. My girlfriend and I are planning on getting married in a country other than her country of residence, and I was curious if the consulates the 3rd party country will accept approve the visa or are the likely to look at these applications very strictly before sending them on to the country of residence. If any one has had their k-3 visa approved in a 3rd party country or knows of someone who has I would really be interested in hearing about your experience.

There is no sending on to the country of residence for the processing of a K3 visa application. If the marriage took place outside of the USA the visa must be issued in the country where the marriage took place unless there is no visa-issuing post in that country, in which case the visa will be issued in the country that handles visa applications for that country.
